AINP- Request for Documents

Hi there,

I've a situation:

I've been working for company x for 4 years. I received my H1-B only 2008 (Effective October 1,2008) from company Y. I then transferred my H1-B to company x, where I've been working for 4 years now( includes OPT, CPT). However, my new H1-B was effective only from Jan 2, 2009 through October 8,2011.

AINP e-mailed me saying that this date doesn't demonstrate the one-year visa requirement.
Can somebody suggest what to do next?

Really appreciate your feedback.

AINP is dead anyways (at least one year before anything happens and the time-line keeps changing/extending and no nominations due to bad economy), so don't worry. And as far as requirements are concerned according to their requirements you have to have one year of H1-B. So yes you will have to wait until you satisfy that.

You can submit your I-797 for company Y (which states the effective date of Oct 1, 2008) to AINP.

But becuase your 1-year experience needs be under H1-B visa, you will be eligible for the program after Oct 1, 2009. If you meet all the requirements (such as NOC code) at that time, then you can apply.

try calling the AINP office and explaining your situation. tell them you have work experience in the US for 4 years. that might help.
