Hi Guys,

I came to usa on H1B august 2005.
I have been working in usa for the part 3 and 1/2 years as software engineer.
2years ago i applied for green card and Now im not using my H1B. but since i am in final stage of green card i got EAD (Employment tuthorization Card) which gets renewed every year. so now im working on EAD but not H1B.

So my question is would i be elginle to apply in AINP(H1B stream)?

If you guys have no answer then from where i can get this answer please advise..

Your case is special....you have the 797, and valid I-94....even though you are not on H1B anymore...but you were...call the hot line..ask them....I haven't heard any case like yours.
But if you are so close to get green card,why do you want to apply to Canada? :)

I am near to Green card but in real i am very far.
there is big q, almost 1 million people in q.
they they giving GCS for people applied at 2001. i am in 2004 list. to move 3 years. it takes minimum 6 to 7 years.
You don't believe its in 2001 one for the past 5 to 6 years.

So no hope.
 
Hummmm,sorry to hear that....so call the hot line..maybe they will be able to help you...or you can apply and see what happens....there is no fee for the first step anyway...

I was on H1B visa for 5 years and moved to a new employer using my EAD card. I want to find out if applicant working on EAD from US can apply for this program. Did you happen to find out from the hotline if you are eligible. If you happen to have info on this, could you please post the response so that my situation will also be clear. I am planning to call them either tomorrow or day after to see if they can give me any response.

Appreciate if you share your experience too

They have clearly mentioned :
"You must be currently working in the United States and possess a valid visa in one of the following temporary skilled worker visa categories: H1-B, H1-B1, H-1C, E-3 at the time the AINP makes a final decision on the application"

So not sure for those who got employed using EAD's...
