Hi all,
big thanks to all, who sent me supportive comments and personal messages!
The Hearing was exhausting.
Mine lasted 1 h 40 min.. I was accompanied by a lawyer (I am the main applicant and wanted to strengthen our main position).
2nd family member's lasted 40 min.
3rd family member's - 50 min. (I was permitted to accompany them and to hand over documents)
The judge did not show much of emotion, but was reserved friendly. The judge did not give us any hints, if the decision will be positive or negative.
I had a suitcase full of documents. But the judge did NOT look at: OHIP, ATM printouts, bank & CC statements, statements of colleagues, printouts of e-mail exchange, photos (have you ever watched a "Green Card" movie?
The main focus was on 1) reading passport stamps, which did not come out well in xerox, 2) Notices of Assessment, 3) Memberships in professional organizations, 4) rental agreements, rental cheques.
The judge was making notes and asked for additional docs like COLOR copies of all passports and all copies of tax assessments for the relevant period of time. We were given 7 days to submit them.
My lawyer (funny, but my lawyer spoke to 7 other lawyers and no one has ever been to a hearing with a CJ - it is apparently NOT a common practice) was permitted to come in. The main purpose was to defend me, in case the Judge would behave in a prejudiced way. But the Judge was neutral, so there was no need for the lawyer to intervene.
The Judge told me, that the decision can be made within 60 days, but probably - as soon as the additional documents arrive, so it won't take "too long".
I personally do not think, the judge will wait: the Mandamus court date is approaching. I expect judge's decision next week.
Best of luck to all of you (and ourselves)!
I will keep you posted.
