Advise Needed Regards Fiancé

Hey Guys,

Just want to start out by saying thank you for all of the help and advise people take the time to share! Really does help.

I am a UK/Canadian passport holder, spent my entire life in England until November 18 when I moved here with my fiancé.

I plan to sponsor her inland for PR before her eTA runs out which happens to be next summer (British passport expiry) however, upon our second entry into Canada on Boxing Day (we went home briefly for Xmas) my fiancé put ‘60’ in the how many nights do you intend to stay in Canada section on the border force machines.

Now my question, as she put that, do we somehow need to let The necessary people know that she intends to stay longer, until we submit her PR app, or does it not matter because her eTA covers her until next year?

Basically, how long can a UK citizen stay in Canada for classed as a visitor?

Hi

An eTA does NOT grant status. It is simply authorization go board a commercial carrier to travel to Canada. If she did not get a stamp in her passport when she entered, she has 6 months of visitor status.

Is that from each date we re enter Canada? for instance, if we take a trip to Detroit for the weekend then re renter Canada, does the 6 months re fresh?

The CBSA would see that she had just been there for 6 months, so they might be a bit suspicious and questioning. The best options you have, in my opinion is:

A) Have her apply for an extension of her visitor visa, even if her 6 months expire she has implied status until a decision is made.

B) Contact CBSA and ask them about how they would feel if you did flagpole her visitor visa.

C) If you do get a visitor visa extension, then you could start applying for her inland spousal sponsorship application. She could also apply for a Open Work Permit so 4-5 months into the process she can start working in Canada.

If this was my current situation, I would apply for that visitor visa extension and also avoid leaving the country if you intend to start her application soon. During your application she can leave for short times, no more than 2-3 weeks, and will have to have a proper Eta or TRV to make sure that she is admissible back into Canada. if she gets denied entry into Canada, her application for inland PR will be considered abandoned.

Hope this helps clear things up a bit!

It re-starts on each entry.

If she entered Boxing Day, she has visitor status until end of June.

Hello again!

Well AOR (acknowledgement of reciept) takes 1-3 months to recieve, and OWP takes 4-5. You might want to apply for that extension just in case, since the time frame will be a tad tight. You could look on CIC website if she will be protected under implied status while the OWP is processed, since im not sure myself( dont want to mislead you).

After OWP is approved you dont have much to worry about. Just make sure she has a valid visa to re-enter canada if she ever wants to go for a small trip out of country.
