Advice please

I have got a solid offer for a good permanent job in Canada but I am worried that a couple of things may stop my visa application. I got caught with a offensive weapon when I was 16 I am now 22, I have not been in trouble with the law for anything at all since other than I got caught driving without insurance, wearing a seatbelt and taking the vehicle without the owners permission (not theft as it was my employers van) this was in August 2013. The reason I took the van was I was working in a residential area and I needed to use the toilet (number 2) and could not find a customer that was in their house I was very desperate and I had to take the van to get to the toilet that was probably about half a mile away maybe more on the way back I never had my seatbelt on and got stopped by the police. Will this affect my visa application? Also I can provide character references and more if that matters these are two of the stupidest and one of them the biggest mistakes I've made in my life. Is there anything I can do to make sure these do not hinder me getting in. I am giving up everything for this job selling everything I have to get the money to be able to do this, should I just stop right now before I get to that stage or should I go for it and do everything I can to assure the government I am good and that these were stupid mistakes in different parts of my life although costly. I can even get a written letter from my old employer stating that he was not there and not able to take me and workmates stating that I really needed to use the van for the toilet and there is no way that I would have used it if I wasn't desperate to use the toilet.


I asked this question elsewhere and got the answer probably won't matter unless you got a felony conviction, now I takeit that means did I get charged with a criminal offence and given a fine by the court, if it means that yes I did 3 offences and given a 430 pound fine and 6 points on my licence.

Are these going to stop me getting in or will it be up to the immigration officer to make a decision about me?

The only thing you need to do is get a Police Clearance Certificate. If in the certificate it says NO RECORD then you are good. If it says a record then you are doomed. But if there was no actual case then you should be good..

I should be able to get a police clearance no problem I am no danger to society or public order or danger I just want to get a better job. The charges will be on my record no doubt but I will have finished paying the fines by the time I go for my visa and I didn't go to court I only corresponded with the courts with letters but this was all brought under 1 charge with 3 offences( I actually don't know if this is true I did get three different fines but was all at 1 time). The policeman even said himself that if I had had my seatbelt on he would not have stopped me he said my driving was perfect but I did break the law and I am paying the consequences. Any more help? Please help this is the job of my dreams.

Need to add this: If your certificate says NO CRIMINAL RECORD then you should be okay.
If there is, then you need to provide explanation letter why you should still be admissible to Canada.
Then the VO decides.

So first step, apply for the Police Certificate and post here the comments on your certificate.

You should read http://www.cic.gc.ca/english/information/inadmissibility/conviction.asp very carefully and follow any of its recommendations. The 2013 offences are you main problem, as you have to have been clean (no convictions) to be eligible to apply for rehabiltation from criminal inadmissability.

Yeah I've read every word of every page on that website about this before I asked the questions it didn't help. I know they will be my main problem but if I have a solid job offer and can get a police clearence I have never caused anybody any harm or done anything really bad and I am sure I could get it I would send them so much stuff (character references, work references from every employer I've ever had and a personal letter from me stating every reason why I should be allowed to go). There is no resin why they should not let me in or no reason why I should get a this the company willing to employ me and driving around will be part of the job so it can't be that bad I just wanted to ask to see if anyone knew.

its not about the job you will be hired for.
they don't care if its a solid offer or a very high skilled position or you have a very rare skills.i you have a criminal record your chances are less then 1% at this time specially you have been convicted in this year not few years back.
you will be considered inadmissible to canada under criminality,and its really serious the visa officer has no ability to use his/her discretion here they just apply the rules the way they are written in the manuals.
they actually deport permanent residents from canada for commiting criminal offences,can you imagine they will let you in on a work permit which is a temporary stay.
apply for a police clearance certificate if it shows clean record you are good to go.
if you see convictions there then forget about canada at least for few years.

Hi Dubc125,

i think if you have been convicted you can apply for a pardon,im not sure about the procedure but you can definitely look that up.
also its worth checking with a professional lawyer i repeat lawyer not consultant if its really a great job offer and you really consider moving to canada.
