advice on lmo refusal

Hi,

I have had my lmo application rejected last week. They have told my employers where they went wrong on the application. One was they didnt advertise the position with job bank. They have now done this, so they have to advertise it for at least 2 weeks bbefore re applying. My cic application is about to be processed without the lmo so obviously when i receive my cic rejection letter in the post, i`ll have to stop working. Has anyone experienced a lmo rejection before? Does the second application take as long as the first?

Also, when my rejection letter comes through, i'm assuming i have 90 days as a visitor, will this be enough time to get my new cic application through? If i get the lmo, can i cross the border and get my work visa on re entry? Crossing wouldnt be a problem as i'm British.

Any help or advice much appreciated :)

They will hold your application at CIC for 2 months (if you applied before your current visa expired) without the LMO so fingers crossed it will be sorted by then and you can continue to work under implied status if not you will get a letter of refusal when as you said you must stop working . Your 90 days is the restoration period from the date on the refusal letter, you have no status in Canada just the chance to restore your status. Hopefully it should be quicker if they write a covering letter when the LMO application is resubmitted. You can go to the border to get your work visa if the LMO comes back quick. We are in the same position and if it looks like it could take a while apply to change as to a visitor sooner rather than later at least then you will have a status in Canada and then when you get the LMO approval you can go to the border. Good luck we are from the UK too and only have 12 days left of restoration its a nightmare thanks to the previous employer.

Thanks for the quick reply. They received my cic application on 18th may, i received a letter from them saying if they didnt get the lmo confirmation by 18th july, they would process it without. I called them on monday to inform them of my lmo rejection and they said they hadnt even started it yet so i reckon i have 2/3 weeks on implied status left. From what i've read from various posts on here, it looks as though the 2nd lmo application wont take as long as the first

I was still going to apply for a visitor extension, of say 6months, just to be on the safe side. And then if the lmo does come through, i'll head to the border to get the work permit as opposed to sending by post via uk/us.

So, what happens with you if you hear nothing within the next 12days? Do you have to leave Canada?

We are going to apply as visitors now and hopefully they will issue visas and then once the LMO is finally sorted out we will need to go to the border to apply for work permits. So stressful!

Hi, how did you end up with?
May I know apply as visitor is easy to get approval or not?
