Hello all,
I would be very grateful if someone would be able to help with this situation below:
I have recently finished my contract job in Canada. I participated in a program called Canadian Camp Experience Program run by Nyquest Training Placement. Their main service is organizing international staff for summer camps all over in Canada. I have filled all the mandatory forms, as well as paid the fees in order to get accepted to the program. Once I have got accepted to the program I flue over to Canada and met the immigration officer. The lady seemed to be quite a bit confused about what I said when I was finally asked about the medical examination. She explained that due to the reason I am intending to stay for longer than six months I need a medical examination in order to do that. I told her that I have completed a medical examination within the program circumstances as I was asked by the agency before I have got accepted to the program. The agency has it's own form for this and which I was given to have it filled as well as stamped by a licensed doctor in my home country. The lady then called the agency and after about a few minutes long chat she presented me with a Charitable Work Permit and let me pass through the gates. I took the position and worked in a camp for a little less than 8 months. My employer wanted to extend my stay with about two more weeks as the camp schedule has changed by the time my contract was going to end. I filled the required form to extend my work permit with that two weeks. I had my forms submitted while I was working and was on an implied status. Even though I have already finished my contract by the time I have got CIC's feedback I am now very surprised. Basically I have not got presented with a the extended work permit and even though the Immigration Officer I have met at the time at the airport found mine medical examination within confines of the agency fine, the Immigration Officer dealed with my extension request didn't and determined:
"that pursuant to section 29(2) it has been determinated that you have violated a condition imposed under regulation 30(1)(c)(i) as you have not completed medical examination."
I have also attached the cover letter of the agency but it seems they didn't take the time to deal with that and simply denied my request of extension without calling or messaging them about my request. To the top of that even though I have got their feedback after I was already done with work I have another 10 days of overstaying in Canada as my date have taken of 10 days after my contract ha been done. The feedback also mentiones that I would have had 90 days to restore my status before they would have taken any action against me but as I have left after ten days they have determined the imperfection of application this has obviously never happened.
I have asked the agency about this but haven't heard anything back yet from them for 2 days now. To perfectly honest I don't know if there was something really wrong about my application or it was some sort of misunderstanding as what the IO found fine on the airport the one IO that dealed my application didn't. I find myself completely innocent about what happened as I did everything as I was told and I don't know how to fix or clearify myself which I don't even know if I need to at all. I am intending to go back to Canada as I really loved it there and now as this has happened puts me into some real fear that I can't tell what should I expect to happen the next time I would go whether if it is for work or travel. I really would like to cleariy myself somehow and would be in need of any advice or idea. (I am from a visa exempt country btw so I do not need to apply for a visa in order to stay as a tourist as long as I do not work.)
Thanks in advance!
Roland
