Guys,

I need to know about ADR.

I got a refusal on the basis my court marriage certificate is not Valid. Visa officer said; I was not able to submit the marriage certificate from the temple where I did my marriage. It means according to them "court marriage certificate is not valid alone". I am very much surprised to see this reason. Even, My wife got an Indian residence permit on the basis of this court marriage certificate last year 2013. Since then she has been living with me.

Today, I got the certificate and the letter from the Priest who performed my marriage according to Hindu rituals. It was Ary samaj mandir in Delhi. Let see if this will help in ADR.

I need to know the process of ADR and time processing.

Since you have the certificate now, have you tried sending it by email to the visa office and asking (politely) for re-consideration(i.e. re-opening your file)? Did the officer give you an opportunity to submit this certificate(i.e. a fairness letter) before refusing you?

No letter was given.

He just asked me at the time of the interview but I didn't have that time. He refused without even requesting me for additional documents.

I got this in refusal letter. What it means?

I am not satisfied that your marriage to your sponsor is genuine or that it was not entered into primarily for the purpose of acquiring permanent residence in Caanda.

It suppose to be -

I am not satisfied that your marriage to your sponsor is genuine or that it was entered into primarily for the purpose of acquiring permanent residence in Caanda.

Correct me if I am wrong

You are wrong. The first sentence is grammatically correct as it applies to your case. It's an English construct called a "double negative".

The first statement(which was in the letter) is 'correct'. The officer was not satisfied about genuineness of your marriage or that you did not enter the marriage just to get PR status. That is, he suspects you entered the marriage for PR status.

The 2nd statement would mean he was satisfied that you did not enter the marriage just for PR status i.e. your marriage is genuine. If this was the case, he would not have refused you.

I presume you are from India and the certificate from the Temple is very important, correct? If you didn't get this certificate, this would explain why the officer had doubts.

Ask your sponsor(wife) to request the GCMS notes on your file. It should have more information about officer's reasons. She can do it through the Access to Information Act(costs $5) here:

Did you order your notes before your interview? Have you ordered it now? Did you provide wedding photos? Its odd they didn't accept the court marriage papers. Most Hindu marriages couples submit their marriage registrar certificate rather than the temples certificate. Also my understanding is that most Hindu temples don't issue certificates.

Did the officer have any other concerns at your interview? How soon did you marry after your first contact? I just think that they have other concerns.

I had few pictures of my marriage. He wanted to see the certificate from the Temple.

Arya samaj mandir issue marriage certificate.

My relation is almost 3 years old.

As I read more cases, it seems the length of a relationship is not a big persuading factor in the absence of other things. There is a lady on the forum sponsoring her husband from Jamaica. They've been together 10 yrs and her husband was refused... something about them not being physicially, emotionally and financially interdependent.

So it will seem the longer a relationship has been, they are looking to see 'progress' too or more substance in the communications e.g. that the plans initially laid out in the application are taking shape.

I feel my case refused because of not submitting marriage certificate from the temple because I have received 3 papers. Out of 3 papers he mentioned about the Genuinely of the marriage or was entered in to primarily for obtaining the PR. (ONLY ONE LINE)

then all 2 pages full of Hindu marriage act 1955.

Visa officer thought we didn't had rituals in our marriage infant we did but we didn't provided the pic or the letter from the Temple which stats that our marriage happened according to Hindu rituals and law. Alone marriage certificate is not valid in CIC.

Today, we got the letter from the priest now. He was explaining how our marriage certificate is not valid.

I think if I submit this new certificate from the priest then it will be valid. If its valid then I am spouse.

I think visa officer felt why it was not genuine because we didn;t Submitted any ritual picture or letter from the Priest regarding our marriage. We only submitted court marriage certificate.

Thats the only reason mentioned on 2 pages.

Actually, we did very small marriage. I had a marriage in the Temple where me, my spouse, my sister and lawyer present. We took few pictures but we forget to take pictures of phere but we did Phere. Even not with my sister but her name is mentioned on witness on Arya samaj certificate which I got it today.

From the marriage certificate we got a court certificate and my spouse got her Residence permit of India. I don;t understand how its not valid when Indian immigration accepted.

I also have US and Europe visa where I mentioned my spouse details. They even accepted. That's strange.
