Need your input please. I m submitting my study visa application, do my 3 and 9 year old children need a study visa too? I have received mixed information on whether I need to apply for a study visa for them or not. Besides the requirement of an acceptance letter is not possible a I know that public schools depend on where one would live (neighborhoods) and I am still not sure where exactly I would live to apply for schools for them.

Please advise.

3 yr old could go to daycare or kindergarten, 9 yr old will go to school.

How long is your program? If it is more than 1 year, usually children go to school "for free", if it is shorter- you have to have an acceptance letter and pay for school. So if your program is 1+ year apply for Open Study Permit for your 9 yr old. And for a "visitor" for your 3 yr old.

Why do not you look at www.cic.gc.ca and figure out if your kids need student visas? http://www.cic.gc.ca/english/study/study-minors.asp

IMHO your 3year old do not need a study permit but your second one needs an Open SP.

It is a 4 year PhD program.

Does the open study permit for my 9 year old require an acceptance from a school? I initiated an application and it has it as a required supporting document.

No you do not need an acceptance letter for your 9yr old. Did you apply for an OPEN study permit for him/her and not just a SP? Open means you do not need an acceptance letter. Please, study www.cic.gc.ca Search- open study permit/ minors). You are going to PhD program, be resourceful! :)

Thank you for your patience.... Actually I checked the cic site, and that is why I said I am hearing different opinions. I didn't know there was a difference of study permit and open study permit, it didn't give me that option when I started my application. I will recheck again.

There is nothing such as OPEN study permit. It is just Study Permit. If you are approved study permit then your children do not require letter of acceptance.

Sorry if you read carefully. If the parent is authorized to study or work in Canada, the child does not require a study permit even if he is applying for preschool, school or post secondary.

So you do not need study permit for any of your child. :)

Please re-read. If the child was in Canada s/he wouldn't a study permit accompanying a student parent. , but since the OP is applying overseas, the 9 year does require a study permit.

This is why I have been saying it is confusing.

So I am not applying for my study permit (outside of Canada) as i got accepted in a phd program. I am doing a family application, so a work permit for my husband and a normal visit visa for my two sons (3 and 9). When I get there I will be able to enroll them into preschool and elementary school with no study visa.

Am I right?

My bad PMM. You are right, my point was for Children who are already in Canada.

NO. You have to apply for a SP for your 9yr old. His intention to STUDY at school in Canada requests a study permit. On Visitor visa they are not allowed to study. As soon as at POE an officer asks what your 9 yr old son is going to do in Canada, and your answer will be "to go to school", you ALL will be rejected the entrance.

The case when a child does not need a SP at all, works only in case as if a child like your 3 yr old is in Canada (on visitor visa) with a parent who is a student (or a worker) for more than 1 year, and then when it is time for a child to go to school (at age 5) only then he DOES NOT need a SP. But going to Canada your 9yr old HAS to have a SP because neither his parent-student is in Canada nor him is in Canada YET.

Hello, mawcanada! Please, tell me how you solved your problem, I am in the same situation. My son will need to attend secondary school if I get my Study Permit ( we are applying outside of Canada), but when I try to apply for a Study Permit for him (since there is no any OPEN STUDY PERMIT APPLICATION FORM) , there is a requirement that he is to provide an Acceptance Letter (which is not applicable in his case). How did you act in yhis case? Thank you.

My plan is to apply for the study permit for him, and write an explaination letter and attach it instead of the application. I will quote that as per CIC rules I understand that acceptance is not required since he is accompanying me, especially since I still have not rented a place and don't know which school options are available for him.
