Hey if anyone can answer my questions, that would be a great help for me.

I am a international student in Sheridan college who got academic suspension. I started my course in Jan 2017 and I got the academic suspension in August. Now I applied for another program for Jan 2018. Now I have four months left for my program to start. So I am going to join French classes, duration of 4 months till my program starts. My question is can I stay in Canada in this four months and after completing my course, will my work permit be affected because I got academic suspension and I stayed 4 months in Canada without being enrolled in a designated institute but studying a course in a non-DLI institute.

Complicated situation...

You definitely cannot work until you start classes again at a DLI in January. You need to be a full time student at a DLI to work off campus.

Your study permit should technically be canceled since you'll be out of school for more than 90 days. I think you'll need to apply for a new study permit before you can start again in January. This bit is tricky since you want to make sure you don't fall out of status and also have a valid study permit by January. You might want to consult with a good lawyer to make sure you do the right thing. It would be easier if the school you plan to attend for the next four months was a DLI.

It's hard to say what will happen to your PGWP. It's possible CIC may issue it - or possible they may follow their rules to the letter and deny it.

Distance learning


Distance learning can be through e-learning, correspondence, or internet courses. Distance learning is a process by which technology is used in ways where the student does not have to physically be in the place where the teaching is taking place.

Since by definition distance learning does not require one to be in Canada, a study permit cannot be issued for this type of course. For example, if a foreign national authorized to work in Canada is prohibited from engaging in studies as per a condition of their work permit, they are allowed to engage in distance learning courses.

However, some distance learning courses include an in-Canada portion to the program (e.g., special tutorials or the writing of final exams). If the overall course of study is greater than six months, then the student requires a study permit for the in-Canada portion of the program, even if the in-Canada portion is less than six months. The duration of the study permit should be for the duration of the in-Canada portion only.

Thank you.. So there is a 4 months On campus course which I can do in order to keep my status until i start my program in Jan. Shall I proceed with that?

You would have to get admission for September. You will have to be a full-time student and you will have to notify CIC online that you have switched programs and schools.

I am in a similar situation. I got my study permit extended till 2022. But I am on academic suspesion till until next fall. But when I spoke to my advisor he said that your study permit wont get cancelled you can come back to school next year.

What should I do? How can i work in this situation?

The school should be reporting your suspension to IRCC, leading to revocation of your study permit.

You can't work.
