About to apply for PR inland, need one more question answered.

The process is: when you are outside Canada you have to apply for temporary resident visa. When you are already in Canada and want to extend your stay as a Visitor (not a student or a worker) you must apply with the other forms. You r still temporary resident. The difference is the only that you continue to be visitor=tourist. Or u can change your status and become a student, but still you are temporary resident. The term "visitor" is used to differentiate temporary residents - students, workers and visitors and find that package of forms which is needed to file for every particular case.

It's the same. I work as a clerk at CIC office. All visitors with visas or without visas are temporary residents.

in the above post, it was suggested a trv is the same as entering as a visitor. i don't believe this to be true. yes a temp resident is the same as a visitor, but a visitor does not necessarily need a trv to enter canada. when i cross the border into canada from the us i certainly do not apply for a temporary resident visa. US is visa exempt. I ask to enter as a visitor. if i'm there long term, then i am technically a temp resident.

There are 3 categories:

2) Permanent residents
3) Citizens

It doesn't matter whether you need visa to enter Canada or you are from the designated country, citizens of which don't need visa to enter Canada as a visitor/tourist, from the point of view of immigration law you are ALL temporary residents untill you get status of permanent.

So, visiting Canada for several days you are a temporary resident, visiting for a half a year you are also a temporary resident.

AHA! you are a VISITOR not Temporary Resident. I thought it was odd that you were from the US and have temp resident status. Mystery solved... apply to extend as a visitor! in the application tell them you intend to send your application after may 30th, and ask for 1 year extension. there's no guarantee how long you will be approved for. you will have implied status until you get the decision. i'm not sure how it works applying for an extension so close to the end of your status though.

Well at this point I don't have much choice.
I'm going to file online for the visitor status extension tonight, after paying the 1040 for my PR processing fees and include the receipt with my extension application asking for 1 additional year for filing and processing times.
After I get a reply back saying I got an extension(Cross my fingers) , I file the outland PR paperwork from within Canada and wait it out.
This all sound about right?

as long as you send your application on or after 5/30. Remember, that is the date you legally become commonlaw! good luck, let us know how it goes!

Thanks everyone for all the help, I'm pretty happy I have a bit more to go on now instead of just going in blind.
I'll throw a reply in this thread when I send my PR paperwork off if I get the extension to let you all know!

also remember, even if for some reason you don't get the extension granted, you still want to send out that outland application. whether or not you are in canada as a visitor has no bearing on sending in the outland app. it just means you'll have to go home, and try to come back again later. i believe with an outland app, you are able to be separated from your commonlaw parter once your application is submitted, as long as you can prove that initial 1 year cohabitation - which is the basis of your application.

OH! and you'll want to include your police record in your application for outland. some people say it can be sent later, however that can create a risk for CIC considering the application incomplete and a delay in processing.
