Hello,

I have a few questions regarding Spouse Open Work Permit and I list out my case as below:

I received an approval letter for my Spouse Open Work Permit and stated that I should enter Canada by July 2022. I plan to enter Canada in April 2022, however my husband finished his study in Jan 2022 and is applying for PGWP at the moment. At the same time, he got a job that is classified as NOC - D, which cannot help me to extend my work visa. So will my SOWP expire on 30 July ? and how can I extend my OWP under the situation that my husband is working on a NOC type D job? Is that I should find an employer so I can apply an employer specific work permit ?

Your SOWP will expire on the date listed. If your husband doesn’t have a NOC A, B or 0 job then you are not eligible for a SOWP under his PGWP. You will need to find an employer, get a job offer and then the employer files for a LMIA. The LMIA is to prove no Canadian or PR could be hired. Then you apply for a closed work permit. It is easiest if your husband gets a skilled job.

Thanks a lot . If unluckily, I can't find an employer to apply a close work permit, can I change my visa to visitor and stay in Canada ? if yes, how long can I stay as a visitor ? 6 months from the date I enter Canada or 6 months from the visitor visa has been granted ?

If you can’t find an employer willing to pay the $1k and file for a LMIA, then you can change your status to visitor. You can extend your status while in Canada from the 6 months you enter.
