Good Day!

I am a new immigrant here in Toronto from Philippines. My mother sponsored me and father. We landed here last September 16 2014, and I am going back to the Philippines by Next year April 2016, I have about a Year and Six months living physically in Canada.

I am aware that, in order to be a permanent resident here in Canada, I have to stay at least 2 years with in 5 years from the date we received our PR Card. But is it possible if I will stay in the Philippines for more than a month can I still get my permanent residency status?

I hope you could provide me answers in order for me to know what to do to avoid violation regarding to maintaining PR card. Thank You.

1. Your Residence Obligation (RO) makes reference to your landing date so ignore whatever date is on your PR Card its irrelevant to the RO.

2. To comply with the RO you need to have 730 days of physical presence in Canada over a 5 year 'rolling' period. This means each day the RO window moves forward by one day e.g RO window today is from Nov 2, 2015 to Nov 2, 2020 but tomorrow will be Nov 3, 2015 to Nov 3, 2020.

3. If you have been a PR for less than 5 years (as you are) then you have until 5th year anniversary from your landing date to meet the RO so Sep 16, 2019 (actually its Sep 15, 2019).

4. If you have been a PR for 5 or more years then you need to have 730 days in the 5 year prior prior to the 'examination' date. Examination occurs any time you interact with CBSA/CIC in a manner that requires your RO to be checked so admission at a Port of Entry and/or PR Card renewal/PRTD/ Sponsorship application.

5. Your one trip month shouldn't be an issue.
