Hey,

I have done a lot of research based on LMIA and things like this... But I have a question...

So i know it takes a lot of time for someone to get a LMIA Approved, and then to hire a foreign national. So i found a document for all companies
which have had a positive LMIA or LMIA has been approved...

Would the application process for one of these companies be fairly short or is it still a lengthy process, if one is trying to obtain a work permit?

The process will be same for all employers.

But other employers apply for a LMIA or a LMO, The companies which im looking at already have a LMIA approval, and have applied for it previously and has been positive.

Does this not mean that they are already allowed to hire foreign nationals without apply for another LMIA??

Also I know the owner of 2-3 Swiss Chalet chains, Could i be hired through him to get a work permit and work in Canada?

1 The approved LMIAs were probably for named employees.
2 If they were able to get a LMIA

So this is not for the company as a whole? meaning that they are allowed to hire someone foreign?

LMIAs are approved at the individual employee level. There is no such thing as a company level LMIA that allows a company to hire any foreign employees they want.

Understood. Okay so would it possible to get a job at a some place like swiss chalet to gain a work permit?? and work in canada?

They would have to get an LMIA. To get an LMIA - they would have to advertise the job for a month to prove no Canadian could be found for the role, then pay a $1,000 fee and then wait for several months (likely) for the application to be processed. So if you're willing to find a Swiss Chalet willing to go through this process, then I suppose it's possible.

I can find a swiss chalet to do this, and I understand what you mean by they couldnt find no canadian to do the role... But how would one prove this anyways ? just by stating they have had lots of unsuccessful interviews?

They have to advertise the job for at least a month and then provide the other information requested in the LMIA application. Human Resources Canada will then assess the application. If they feel the restaurant should have had no issues hiring a Canadian for the role based on the current job market conditions in the area - you can expect the LMIA to be refused. If there is a shortage of workers, this improves the chances the LMIA will be approved.
