Hi, I have a question about my kid from previous marriage, anyone please gives me some suggestions.

I have a child who's living with his dad now (his dad has custody) and I didn't ask him to do the medical things because I'm not planning to have my son here now. However, what if I changed my mind in the future? Will I still be allowed to sponsor my boy if I don't provide his medical things this time ?

Also, is it fine if I send him to do the medical things now ? what kind of application should he use when I'm applying inland but he is in Taiwan and how can I send the result to CIC since I've already sent my application last Nov?

You have to have included your child as a non-accompanying family member on this application and I believe he needed to go through a medical in order to ever be able to sponsor him later. If your ex has custody, you need to provide some sort of proof that you would be allowed to bring him here (ie consent from your spouse and a custody order-even if it's shared). If you don't declare children in the begin, you are not eligible to sponsor them later.

I've included the kid on the non-accompanying family member part and also provided my divorce paper which claim that the boy is belong to the male part. I discussed with my ex and we decided that the kid is still going to stay with father and the kid can choose to come here or not in the future after high school. That's why I didn't think about his medical things.

According to your answer, I thing I need to send him to do this right away. Do I also need to provide a letter from my ex to explain our decision?

My child is in the sole custody of my former spouse. Do I need to include this child in my application?

You must list this child on your application for permanent residence, but the child does not need to be examined if you do not have custody or responsibility for the child through either a written agreement or a court order. However, if the child is not examined, you cannot sponsor him or her as a member of the family class in the future, regardless of changes to custody or living circumstances. If you want to preserve your right to sponsor this child in the future, you may wish to have him or her examined as part of your application.

--- Based on this I would say, yes you need to have him examined now to be able to sponsor him at a later time, even if it's years later. Also, I would say it is safer to have a letter from your ex spouse explaining this decision or at the very least for you to explain currently while you are not bringing him now. I hope this helps. ---

oh, thanks a lot, I don't know how to show my appreciate here.......plz forgive my poor language skill....

Please allow me to ask one more question
should I send the explanation letter right away since I've already sent my application or I should wait until CIC ask for it ? ( bcos I'm worried about they may lose the letter if I sent it without their requirement)

If you have a file number then I would include your file number on it, let them know that the medical is coming so that they are aware of it as well. You dont want your application to get to far into the process then be trying to amend it and slowing it down even further. I am assuming you made an inland application as I see Vegreville is your VO office and not Missisauga.
