Dear all,

Can we assume that those categories which are no more at this time present in CA immigration skilled work categorey, may face same issue.

Because when i applied for immigration my job cate. was very much present and i obviously i got OK from initail assesment. and now these categories does not exist in the NOC list.

In theory, whether or not the occupation is on the current in-demand list should not influence a visa officer's decision as to whether the applicant is eligible, since that should be based on the rules at the time the applicant applied.

The reality, I suspect, is that they will still pass cases which are clearly eligible, and still fail cases which are clearly not - however, when the duties performed are borderline, I think the officer is more likely to pass cases if they are on the current list. The overall strength of the application I also suspect plays a part in these grey-area/visa officer discretion decisions.

CIC in the area of duties performed seem to deliberately leave the op manual a bit ambigious (you note they do not define exactly what a "substantial number of duties" is), so that the visa officer has a certain level of discretion to pass or fail borderline cases.


Just my 2 cents on the notion that CIC are trying to "fail" cases where the occupation is no longer on the list. In my view this isn't quite correct, but certainly I think it's an influence if your application is just "on the edge".

thanks for your reply, but how can i get job offer? how can i find the employer to give me job offer.
as i said before, some one very close, he got fake job offer from canada caz his relative in canada had a friend and he running own business at his basement !!!!!!!!!!!!!!, and fake work experience and with very low IELTS point. just he finished his college, now he is living in canada. he didn't do anything just he moved his ass to sit in airplane, his relative did all the work for him. and again with fake report he bought house too. what can i say what can i sayyyyyyyy. Do you think is it fair? really is it........... if i had a ball i report him asap, caz i suffer form this unfair situation very badly.............
so now pls let me know how can i find employer that can give me real job offer?

OK the number one thing to remember is NO Canadian employer is going to offer you a job without meeting you. So any agent who says he can get you a job offer without even meeting the employer is almost certainly lying.

You need to set up interviews and actually meet the employers.

What I would do if I were you
1) Decide on a time when you can visit Canada and book a holiday (1 to 2 weeks)
2) Arrange any visitor visas you may require to visa Canada
3) Between 2 to 4 weeks before you go, try to see if you can arrange any interviews up front. Contact companies (by telephone will probably get better results than by email), state the dates you will be in Canada, and would you be able to meet with the to discuss employment opportunities at their company?
4) Once you get to Canada attend any pre-arranged interviews and see which other interviews you can arrange

Very few companies will want to arrange an AOE (Arranged Employment Offer) and wait 1+ year for your residency to come through, so the most likely scenario is they will offer you a job and try to secure an LMO (Labour Market Opinion) so you can get a temporary work permit, start working in Canada, and apply under FSW2 whilst working in Canada.


The FSW2 route undoubtedly involves more effort, especially since you need to get the employer to apply for an LMO, which involves their making sure they have advertised the position on Jobbank for at least 2 weeks in the last 3 months with no suitable Canadian found to do the job.

But it is by no means impossible.

I guess you have to ask yourself, how much do you want to get to Canada?

thanks for your advise, sorry to tell you but..... you are not living in 3th world country. and you can not understand how people do fake thing and lie things and get visa and live in canada as i said If I had a ball I reported them from beginning. it is hard to tell everything here but which i see with my eyes and in real life is different. the lier people get better life who be unseat and respectful will be down. it is call jungle not human world. that is why i suffer more.
