A question about domestic assault/ overstay

I was looking for advice about a complicated situation. I am Canadian and met a man who was here on a work visa. We got engage and had a child. He was fired from his job and subsequently assaulted me for which he was jailed.
His charges were stayed and he was sent out of the country. I don't know if it was a deportation or exclusion order based on Canada's privacy laws.

BAsed on the assault and overstay of his visa, will he ever be allowed back to Canada?

Also, I found evidence of his intent of using me for immigration via child/sponsorship which I reported to Immigration Canada.

Anyone???

I don't ever want to see him again...ugg

Nobody can say for sure, its never 100%....
Its unlikely that he'll be allowed back, but he can appeal, do a rehabilitation application or get an ARC etc.

Make sure you let CIC know the evidence you have so they can keep that on file for possible future attempts he tries to get into canada

The overstay, in and of itself, is bad...but the assault against you is by far the deal breaker for him returning anytime soon. However...since you have a child together, he probably has parental rights if he wants to see his child. This might even mean that if he applies for (and is granted) an ARC (Authorization to Return to Canada) and then gets a TRP (Temporary Resident Permit), AND...if he has a right to see his child...he could in fact see you again, perhaps.

How was he able to initiate the child/sponsorship that you mentioned? You would have to apply to sponsor him, which you clearly would NOT do, so...how is that even an issue? He would need to wait until your child is grown, who could then apply to sponsor him as his/her parent, which would take a few years and is not easy to do!

The evidence I found was dated from before we started dating, so no I never sponsored him. As far as parental rights, I have sole custody and there is no acess granted.

I will definitly give cic the evidence of this case.
