Hey guys

My name is Kevin and i'm from Saskatchewan. We've been sponsored by my Dad like 2 years ago with my siblings and mom. I started being in a relationship with this girl like 6 months ago she's 27 and i'm 24 who is currently in Saudi as a nurse and we're office mates back then when I used to work in the Philippines. We'll both have our holidays in the Philippines on January of 2014 and My question is, if I marry her let's say in late 2014 or early 2015, is there a big chance that she can migrate here in Canada? My family is also planning to apply for citizenship maybe in 2015 will that make a difference if I filed as a PR and as a Citizen? I tried reviewing the common law stuff but we need to live in together for at least 1 year to process it, and also the Conjugal partnership which we can work with but we need to open some joint accounts and stuffs like that

I will really appreciate the answers and suggestions, cuz I really don't have any idea on what to do and where to start. We just want to be together and we're actually both from a relationship that fell off like a year ago because of the distance and we don't want that to happen again.

Thanks!

If you marry her, you can sponsor her.

Is she from the Philippines? Outland application currently takes 15-16 month.

You can't, If she is outside Canada and don't have a valid status here, it will be processed in her home country.

Forget conjugal. It is very hard to get approved if there is nothing that stops you from getting married. You should go to her, marry her, sponsor her. It does not matter if you are PR or a citizen. Just that the sooner you marry, the sooner you can sponsor her and the sooner you can sponsor her, the sooner she will have her PR and be in Canada with you.

If she can get a visit visa to visit Canada, then you can sponsor her inland but then she will be stuck in Canada without working until she has her first stage approval, usually 6 to 9 months. You can try applying for her visit visa and see if you get it.

Thank you for all the response. Yes we are actually planning if maybe we could try to get a tourist visa and prolly get married here but I heard rumors that if you're a nurse it'll be a pain in the arse to get 1. Is that true?

1. Canadian PRs (residing in Canada) and Citizens can sponsor spouses in the Family Class. There are some requirements on your part such as not being on welfare or having applicable criminal convictions. She will have to pass a medical and criminal checks. CIC must also find the marriage bonafide - your meeting in Philippines is useful towards this. Other factors such as age, culture, educational compatibility help. Head to the family forum for further help on this.

2. You are unlikely to be a citizen much before 2016 given current processing times so sponsor as a PR.

3. You will sign a sponsorship declaration - this compels you to repay any welfare your spouse claims for 3 years after landing even if your marriage doesn't work.

4. Your spouse unless you have kids will get probationary PR status which can be upgrade to full PR status after 2 years subject to a review that your marriage is still legit.

5. If your spouse to be has a travel history (to the EU/US/Australia) and long term residence rights with solid employment in Saudi she will get a visa if not then unlikely. Visa Officers will bounce any visit visa application where it seems the applicant won't leave Canada..the minute she mentions you in the visa application and the nature of your relationship then IMHO its a no dice!

6. Out land spousal application is faster than inland.

good luck
