Hello,

I am Canadian Citizen..I have been married for almost 6 years now.My husband and I have 2 children together and now i want to apply sponsorship for him.My husband lives in the Netherlands he is a dutch citizen.

My questions are:

-Is it better for me to apply while he is in Canada or while he is in the Netherlands?

-I used to visit my husband in The Netherlands and I gave birth there, so my husband got me residence permit to be able to give birth there...my question is What happens if i apply while i have residence permit in a other country? Does it effect the sponsorship application?

I would really appreciate your help....and thank you in advance.
 
Hi Mido...

If you apply while in Canada with your husband, the process takes longer than you are doing an outbound application. If I am not mistaken, I believe that if you are currently living in another country it does affect your application because you will have to show to immigration that you intend to return to Canada when your husband receives a permanent residence... maybe a senior member could confirm this info please...

Dutch outland applications are processed in Berlin and Berlin is rather slow although some people have said it is a lot faster than the 80% of cases processed in 14 months which they publish on the CIC website.

If you go to Canada together, you can sponsor him inland but then he would have to stay in Canada and wait it out. He would not be able to work for 8-9 months until he gets first stage approval.

If you would like to go to Canada, you could go ahead and settle things there. You husband stays behind for a bit, but already changes his official residential address to your Canadian address. Like that you can file inland.

If your husband is 30 years or younger, he could apply for a WHP or YP work permit through Berlin. Those are the easiest options for him to start working in Canada. Otherwise, you will need to accept that he needs to stay unemployed for a few months. Immediately file for an Open Work Permit with your application and this will be given as soon as you will be accepted to sponsor him (like Leon already mentioned). This OWP is not possible through outland and Berlin is indeed pretty slow.

Your dutch 'verblijfsvergunning' should not affect the application, you could actually use it as a proof for your relationship.

If he comes to Canada as a visitor, he can (usually) stay for 6 months, and can extend his stay. While he is in Canada you could apply for his PR visa inland.
However, you can apply for his PR visa outland if he stays in the Netherlands, and if he comes to visit you in Canada.
People usually think outland is better for applicants who can enter Canada without a visa.

It won't hurt his application. In fact, it is more proof that you have a genuine relationship.

I belive that's why my application went through quite quickly, as my Canadian husband had already obtained PR in UK to live there with me, then we decided to come to Canada and as we had already gone through the process to get him into UK and live and work there, it showed that I didn't marry him just to get to Canada.
