A complicated case

Hi there,

I have been looking for a job in Canada for sometime now. I am an English teacher with 5+ years experience in teaching. I have applied online through various websites for teacher assistant jobs and I am having my fingers crossed. Hoping for the best.

Anyway, I have two questions. How do people go about getting job offers from Canada? Do you contact job agencies or you randomly look for jobs online?

Also, my husband has gone to Canada on a TRV in January. I know that TRV's are only valid for 6 months but he decided that he does not want to come back and wants to live there illegaly! I know its a stupid decision but hey its done. His visa has expired in June and ever since he is illegal.

Some people told him that he can become legal if he creates a "fake" case to the authorities in charge that if he does leave Canada, he will be killed or something of that sort. We are Afghans so such cases do apply on us. lol. But he has to wait for a year or so and live there illegaly in order for him to be able to apply for such cases.

Has anyone heard of such situations? What can he do in order to continue living there legally? What will happen if he gets caught? Can he file a lawsuit or something that can help him live there?


Please do help me in answering my queries. We are in a nerve-wrecking situation and it's just so tiring! :(

Unfortunately you really have zero chance of finding a job as a teacher in Canada. In order to hire you, an employer would first have to prove there are no Canadians to fill the role. Teaching is one profession in Canada where there are currently far more people looking for jobs than jobs available (it's been like this for a while now and this isn't expected to change soon). As a result, it's pretty much impossible to secure a teaching job in Canada as a foreign worker. If you want to work in Canada, then I would recommend you look at jobs other than teaching.

What your husband has been advised to do is file for refugee status. This is far easier said than done. You have to provide hard evidence your life is in danger and you can't return to your home country. Since your husband is already in Canada illegally, if he files for refugee status, his file will be very closely examined because CIC will quickly suspect he's making up his story just to stay in Canada. If he falsifies evidence, he should expect this lie to be discovered, his refugee claim to be refused, and be forced to leave Canada (once he leaves it will be extremely difficult to return). Whoever told him has has to live in Canada for a year illegally before he can apply has no idea what they are talking about. He should stop listening to these people because they will just end up ruining his life more than he has already managed to ruin it himself.

Thanks for the reply. It really helped, I would still like to know what kind of jobs can English language and literature get me? I looked up for ESL teaching and applied in Canadian Job Bank but I don't think anyone will contact me since they wanted local residents as you mentioned.

Can you please tell me as to how can I get myself a job offer? I don't mind working anywhere as long as it is a decent job. Any tips and ideas will be appreciated.

As for my husband, I hope things work out for him . Do you have any idea how long does the refugee thingy take? 1 year? 2 years? ... ?

There is no requirement for a time frame to be in Canada already to apply for refugee claim. Its processing depends upon "his case presentation in front of judge". There is a term here for the people who get approved in the first hearing i.e. at least judge believes that their case is genuine and they should be allowed to live in Canada as a PR.

Still it takes about a year of processing after that to actually receive a PR card. I know a few people who have been through it this way.

However, apart from the other difficulties mentioned already, please do know that applying for refugee status (if accepted) means he would loose his previous passport and won't be able to travel to Afghanistan - most likely EVER. There are exceptions with people who take chances and play around with immigration.

But the hard fact is - if you take refuge because of a danger to your life in home country, you shouldn't be looking to go there latter, even after becoming a citizen.

If you actually do, you might not have a problem exiting Canada, but upon re-entry if the CBSA officer finds out your status being a refugee and sees a stamp of entry / exit from the same country, he might actually be able to revoke PR. I don't know the exact details but it is great risk.

Besides, sponsoring dependents from home country (like you - wife) might be a life long issue. If i remember correctly he won't be able to sponsor you for a good number of years.

All of the above are issues EVEN WHEN you successfully get refugee claim. In most cases like above, they keep hanging back and forth in courts for a long time, possibly years.
