Here is the link to the news http: //goo.gl/3FDgmt (remove the first space in the link. the original report was in Chinese). This seems to be the first news about the status of the 5000 cap. I cannot find any English news on this.

I post the English translation (by google, edited by me) here:

During an interview on the 20th, Federal Immigration Minister Alexander (Chris Alexander) said the parents and grandparents sponsorship (PGP) reopened on Jan 2nd has received about 7,000 applications. Among the 2,500 applications that have been opened, 1,200 applications are complete, while the remaining 1,300 were returned...

He explained that the main reasons for a package being returned are incomplete documents or the forms are not filled out properly...

It will be interesting to see the reactions from those on this forum that are on the "rejected" list, and why the applications were returned.

Wow over a 50% rejection rate? That's high. I too wonder what the main reasons were.

Agreed with 1 and 3. Either not submitting NOA for 2010/11/12, or scanning forms and not having original sigs.
I highly doubt any applications were returned due to forged signatures, as that is often hard to prove without proper analysis.

Then there are the general reasons for return like
- missing a form
- missing a signature
- payment info was wrong
etc etc

I think the refusals for fake signatures will come later, when VOs look at the applications in depth and see that an applicant 10 000km away signed the forms and got them in to CIC within a few days. CIC will probably request evidence, such as the courier receipt, to prove that the applicant actually mailed the forms from the home country.

Some parents are here on Visa's and holidays. Like my parents, who were luckily here for Christmas signed the forms in Canada.

I would be shocked if CIC did that. A sponsor/applicant could just say they sent their app with a friend who happened to be travelling to Canada on that very same day. Since showing proof of how an app got from point A to B (before it was ever submitted) is not a real requirement, i don't think CIC can actually ask for it or refuse an app if someone doesn't show it.

CIC can request whatever documents or evidence they want if they suspect misrepresentation in any way, and they can refuse an application if the requested documents aren't provided. I don't know how CIC would go about it if they suspect a forged or unoriginal (faxed or emailed) signature but I hope they won't simply ignore it.

As Ralph would say= That is unpossible..

Courrier evidence..cmon..it is definitely possible to print forms by 31..and get it over by 2nd or 3rd jan..possible with DHL emergency service as someone had mentioned or arranging a traveller both ways

A faxed, emailed, scanned and printed signature can easily be determined as it's not in ink. So those apps could be rejected pretty easy.

Proving a forged signature will involve a CSI style team. Proof of courier would not be sufficient as there are various ways to get packages from A to B, the easiest being having someone personally deliver it.

Just to clarify ... once they charge you the fee to your credit card, it means the application is complete and will start to be processed?

Most likely that means they have accepted the app as 1 under the 5000 cap.

However don't expect processing to start for a while. In 2015 there will still be a backlog of 43,000 applications... and the 5000 accepted in Jan 2014 will be added to the very back of that queue. So it may be a year or longer before anyone even looks at your app for first stage processing.

Without studying closely, a signature in black ink looks pretty much the same as a scanned/faxed signature. A lot of people get away with it, IMM1344 in spousal sponsorship apps being a common one.

CIC doesn't need to prove that the signature is forged. If they suspect misrepresentation, the burden of proof is on the applicant to show that there is no misrepresentation.

I never said that it wasn't possible for people to get the forms here within a few days, nor did I say that proof of courier would be a definitive way for CIC to determine it.

But given the fact that they only gave 2 days between releasing the forms and accepting apps, and that they capped it at 5000, CIC knows that it would have been a mad rush to get it done and that some people will have taken shortcuts. We'll just have to wait for the rejection letters to start coming out to see how CIC is dealing with that.
