Dear guys, my e-cas is IN PROCESS stating that my file was started processing on Oct 28, 2007.
I'm i in a safe position.
why an immigration officer would not assess an application directly upon receipt against the points grid.
I appreciate any response from an experienced person. thanks

Read Carefully

Q4. What does a "decision based on selection criteria" mean?

A "decision based on selection criteria" means that an immigration officer:
has assessed your FSW application against the points grid, and
has made a decision on whether or not you meet the selection criteria of the program.
Currently, the pass mark is 67 points out of a grid worth 100 points. The grid considers the person's:

ability in English and/or French
education
work experience
age
whether they have a job already arranged in Canada (arranged employment), and
how well they might adapt to living in Canada (which awards points for things like previous work or study in Canada, spouse's education and relatives in Canada).
If your application is successful, you would move to the next phase (i.e. admissibility). At that point you would be checked against health, security and criminality requirements before being allowed to enter Canada.

If you do not score at least 67 on the FSW points grid, your application would be refused and CIC would inform you of the decision.

It means your status must have reached IN PROCESS with a date to get bypassed from this proposed law. an I/O asses your file only when you see your Ecas reaches IN PROCESS with a date of commencement of processing

Q5. How would I get my refund?

More details on the proposed change will be announced soon. Once the proposal is approved through Parliament, CIC will begin to return the fees.

Details will be available on the CIC website.

Q6. What options would I have if my application is removed from the backlog?

If your file is closed by CIC, you may re-apply under the current FSW criteria. If you have the skills Canada needs now, your application would likely be processed much faster – new FSW applications are processed within 6-12 months.

IO's work on many files and while working on them, they get Departmental, government, ministerial instruction which make them witholding those applications. e.g: Fast Track before 2008.

That proposal has not yet been passed in the parliament, let is get passed. I dont know when it would be places before the parliament but there is a good chance that it will be passed. read my above post carefully, you will get your answer.

you missed out applying for 2nd time after June 2008. you had your NOC opened until June 2010.
not all applicants applied before June 2008 will have their files returned. only those whose files have not reached a selection decision by a VO. read my above post

CAUSE THEY WERE BUSY SIFTING THROUGH ALL THE APPLICTIONS TO CHOSE THE ONES THAT FIT THEIR NEEDS, THIS THING HAS BEEN PLANNED FOR 2 OR 3 YEARS OR MORE.

i just received a reply from warsaw office in response to case specific inquiry sent 2 days ago through e mail

"Dear Applicant,

Please note that CIC is working to closely manage arrivals in Canada, so that we meet, but do not exceed the immigration plan set by Parliament for the current year. Since we have larger inventories than limits within the immigration plan for admissions to Canada, we must stagger the issuance of visas throughout the year.

As a result, we cannot advise you when this case will be ready for finalization or when we will be in a position to communicate further requirements.

No further correspondence will be entered into until we are in a position to communicate a decision or further requirements.

the law will be 100% approved because the party who proposed it has majority so they consider it has passed even if officially it hasn't yet

i think that i passed selection criteria as my Caips indicates 76 out of 90 !!
