2 years banned due to misrepresentation

Right, some people may forget to mention something on their application but many more will deliberately lie about something they think may cause delay or problems and then claim to have forgotten or in some cases like this one, the council of the spouse actually advised them to lie and they decided to do that rather than seek a 2nd opinion.

However it happened, they are now in a pinch and will have to deal with delays and/or appeals. For them it is too late to undo what they did but for others, it serves as an important reminder to be completely truthful on your application, even about things that may not seem important.

and what is wrong if you have been divorce it is not crimnal or will delay your Papers unless you have something to hide.

I believe you have to be thankful for God it is only 2 years not more.

OP.....there is no advice because you broke the law and now have to pay for it with a 2 year ban from Canada.

The advice everyone has given you is sound. Either get a decent lawyer and appeal (which in my opinion would be a waste of money because I doubt you will win0 or wait for the ban to end.

Unfortunately, whatever the reason, you lied on your application. Whether counsel told you to do so or not is neither here or there, YOU signed the form thereby YOU lied.

And yes, we all make mistakes but we have to pay for them.

You said your spouse sponsored you in 2008....it is now 2010...would your 2 year ban not be almost over now??

According to the publication I quoted back in post #3, see http://www.canadavisa.com/canada-immigration-discussion-board/2-years-banned-due-to-misrepresentation-t53480.0.html;msg427676#msg427676 it seems that the ban starts at the time they make the decision about the ban so instead of the ban starting in 2008 when they applied for sponsorship, it would start in January 2010 when he had his interview.

I have already given my advice and that is to get a lawyer and appeal. Their other options would be to wait out the ban (another 15 months) or try to appeal themselves.

Matanol..I really hope you take our advise and get a good lawyer and appeal..

Whether you deliberately withheld the information about your previous marriage or made an honest mistake is really non of our business and the only thing that matters now is that you take steps to correct this mistake! Immigration has punished you with a 2 year ban starting from Jan 2010, you cannot turn back the clock and undo your mistake..you can however appeal and ask for a pardon..if you have nothing to hide it should not be too difficult to show Immigration that you really are sorry and it was a silly mistake on your part. Everyone wants a speedy case and to be able to spend the rest of their life's with their loved ones..and we all do silly things and make bad decisions just to be with the person we love..Nobody is perfect...

Hi all,

I am marrying my girlfriend in June but she was banned in 2014 for misrepresentation due to the question of whether she applied for a visa before, it was an honest mistake, the question was not answered and when immigration sent for information, the letter which was sent to refuse the visa was forward to them. She has a 18 year old daughter who would be 19 in February 2016. Since the application process takes a few months for immigration to process it, can I apply for her in November 2015 so that her daughter would be locked in as a dependent child? I just really need advice.
