Hi all,

I am marrying my girlfriend in June but she was banned in 2014 for misrepresentation due to the question of whether she applied for a visa before, it was an honest mistake, the question was not answered and when immigration sent for information, the letter which was sent to refuse the visa was forward to them. She has a 18 year old daughter who would be 19 in February 2016. Since the application process takes a few months for immigration to process it, can I apply for her in November 2015 so that her daughter would be locked in as a dependent child? I just really need advice.

You can certainly try. However there's certainly a good chance the application will just be returned unprocessed since your girlfriend is currently under a ban and you will be told to re-apply once the ban is over.

Can you give us some context on why she got the 2 year misrepresentation banned, did she hide something while trying to apply for a visa?

What exactly did the ban say? When was it dated and how long is the duration?

she was banned because she answered no on the question if she applied for a visa before. the ban was for 2 years from June 2014. the question was omitted and they sent to ask for more information to give her time to send documentation and she sent the rejection letter which was sent to her when the visa was refused, but she was still put on a 2 year ban. this was processed in Trinidad.

what visa was she applying for a TRV?

so my question really is, is it wise to apply in November since her daughter will be 19 in February so that her daughter can be locked in as a dependant child?

I think scylla said all there is to say:

hello everyone the ban was increased to five years now for misrepresentation, what if it happened 2013, will it still be 5 years?
