Hi Darky07,

I was under that same situation. I received ITA under the last draw on Sept 18. I had filled out everything as you did but last minute my employer said that he wont be giving me an offer of employment. So I declined the ITA because I didn't want to misrepresent myself. I might be wrong but its better to wait for the next draw than submitting an application without the offer letter.
Other people can chime in too. But in my case, that was the best decision I could for myself.

Best wishes!
Thanks for the reply. In my case I have an offer of employment but that is not permanent. So I am leaning towards declining the invitation aswell and make the changes in the profile that I don't have a job offer. Hoping for other people to reply so I can take a decision.

Received Invitation , Filled in the online form and got the checklist .

I did my police clearance for India last year and it was valid for just 6 months , Now that 6 months have gone by , should i get another PCC again now ?

I have not gone to india after getting that PCC and i also read from the link ( cic ) that it is not necessary if u have not been in india after getting ur last PCC . Could someone clarify ?

http://www.cic.gc.ca/english/information/security/police-cert/intro.asp

"For countries where you have lived for six months or more, the police certificate must be issued after the last time you lived in that country."

ideally i am assuming i should be giving my old PCC and also attach an explanation to it explaining the same .

You should decline it. Check the help section on cic. They have clearly mentioned that answer the first question as Yes only if u have lmia approved job offer.

You don't have to decline the ITA.

That question is about LMIA supported job offer and should be answered as YES only by those applicants who have such a job offer and then they would be allocated 600 additional points. Just answer NO to the 1st question itself in your post ITA application and the document requirements would change.

That PCC is valid, no explanations needed.

But you still have more than 450 points which was the draw cutoff. The only difference is that you will be showcasing POF as well. There is no real reason here to decline the ITA.

I would not take that risk. You would be uploading documents against this new link. The reference letter would say you have a temporary job and you may get rejected by a stupid cic visa officer.

Check their OP. They have a CRS of 466 not above 600. Which means they haven't been invited for having an LMIA job. The officer wouldn't be expecting to see a permanent job offer letter document.

Every job that had an LMIA had an expiry date. It is up to the OTHERWISE nature of job with employer whether you could call that permanent or at least valid for a year or not.

PERMANENT OR VALID FOR AT LEAST a year were the wordings i read in CICs official description of EE.

In several of my fellows cases who are done with PR via CEC / EE, all of them got letters from employer stating that.

But all of our jobs never had an expiry date in the first place, just a work permit expiry date based upon LMIA.

So if your employer can confirm the job is on going there is no other concern.

That's a risky assumption. They might let you go without job offer since score even exceeds that still OR they might treat it as misrepresentation if you don't provide a supporting letter and cancel. I would say if you have a genuine job and can show that retain it. If you don't its better to not claim that. Though i wonder why would one submit profile stating job without confirming it first.

I agree with you. It is a risk to go ahead with this ITA when you know that you would again get an ITA in the next draw after making the correction.

Personally, I would not change any of my answers after ITA to be on the safe side.

It's not an assumption.

CIC explicitly state that if the recalculated score is higher than the cutoff of that particular draw, the application would still be processed. Which is the case here. The OP has sufficient points without factoring in their LMIA job.

DO NOT DECLINE any ITA, your score is 466 and you didnt claim points for having a job offer which gives you additional 600 points so its no misrepresentation!

I would say since your job has an end date, you should just say NO to having a job offer and then you can include a LOE explaining that you did not understand the meaning of JOB OFFER when u filled out your express entry profile and however you didnt get any points for it, but however you have to meet the proof of funds requirement!

I faced same dilemna myself as well, but i didnt decline, i left my answer as YES to Job Offer and NO to LMIA, and i had to show offer of employment and letter of employment which included promotion letter, although mine stated fulltime regular.

SO i would say you are good to go with your application and keep praying. GOODLUCK
