2 months short of CEC Exp (but have exp which falls before 3 years in Canada)

Hi Friends,

I am husband is planning to apply under CEC class. But he is currently 2 months shorter. His WP permit gonna expire soon. He has only 10 months experience in the last 3 years exactly. but he have experience more experience which falls before 3 years in canada.
i.e 2009 - 2010 July. Will they consider the experience in 2010 from Jan to July?

Will there be any exception in our case?

Hello Yamini,
Unfortunately not, the work experience that you get has to be within the last three years. I doubt that any exceptions will be made. You will have a better chance if you look into ways that you can extend your work permit. You might also want to consider approaching a lawyer, to see what your options might be

From CIC website:

You need to meet these requirements to apply under the Canadian Experience Class. You must:

  • plan to live outside the province of Quebec
  • have at least 12 months of full-time (or an equal amount in part-time) skilled work experience in Canada in the three years before you apply,
  • have gained your experience in Canada with the proper authorization
  • meet the required language levels needed for your job for each language ability (speaking, reading, writing, and listening).

So no, experience gained prior to three years before application is not being counted towards CEC experience.

Agree with skinnybob. CEC is a pass or fail system, and the regulations state that you must have 1 yr skilled experience within the last 3 years. Eligibility is the main component and he would not pass with 10 months. We have seen CIC refuse applicants that had a 1 day or even a few hours missing. Look into extending his work permit first and then later, consider CEC for PR.
