Hello,

My PR card is going to expire on October 2012.
and i was out of canada and i do not meet 730 days requirement as of now if i count the start date as the date when i got PR.
However i do meet 730 days requirement in last 5 years, because i was living in Canada before i got immigration with legal status.
Can you please tell me should i wait for time when i will be completing 730 days from PR date or can i apply now?

Thanks

The days you were in Canada before you became a PR cannot be counted towards the 730 day residency requirement.

If you have been a PR for less than 5 years, you count starting from the landing date and the criteria is that you have not been outside Canada for 1095 days or more since you landed as a PR.

If you have been a PR for more than 5 years, the period is always the last 5 years.

If you are in Canada, you can let your PR card expire, wait until you have 730 days in the past 5 years before you apply to renew.

Thanks scylla and Leon.
I was in the impression that it is last 5 years in Canada, does not matter if i were PR or not.
Do you have the link from cic where this information is listed?

Thanks again

You're confusing the PR rule with the citizenship rule. For citizenship, you can use the year before you became a PR towards your citizenship residency requirement (each day spent in Canada before you became a PR counts as half a day toward your citizenship residency requirement).

For PR you can only count the days since you landed and became an actual permanent resident.

I'm leaving for the day and unfortunately don't have time to find a link...

Actually you can 2 years prior to PR in Canada for citizenship. It gives you a maximum of a year credit.
