2 Applications at the same time?

Hello,

I entered Canada with my Working Holiday Visa which expired end of september this year. I have already applied for a work extension. I am still waiting for the decision. Now I am wondering if I can apply for a visitor visa now in case my work extencion rejected. So I would not have to leave canada immediately because I would have a visitor visa.

You cannot apply for a visitor visa from within Canada.

Ok that means I have to leave the country and re-enter to get the visitor visa stamp at the border. I have thought I could avoid that.

I am guessing you dont need to apply for a visa at a visa office? Yes you leave and come back as a visitor. Be prepared for secondary inspection since they may suspect you may plan to work while a visitor.

You want a Visa or to 'extend your stay as a visitor'?

You can't get a Visa Stamp at the border. From OP I think you want a visitor status... are you from a visa exempt country?

OP cannot apply for visitor extension as he/she did not enter as a visitor

Yes I am from a visa exempt country (Germany). I want to extend my stay. I have applied for a work extension already. I was just wondering how I can stay in canada legally without leaving the country if I get rejected. I would then change my plans and go travelling around canada.
I know it is not easy to get a work ext. visa but I am still hoping...

IECs cannot be extended - so I assume you applied for a new closed work permit tied to your specific employer with an approved LMIA? Or did you applied for a new IEC? Note that IECs don't benefit from implied status. So hopefully you stopped working as soon as your IEC expired.

Assuming you applied for a closed work permit, if the work permit is refused, you can apply to restore your status at that point and at the same time apply to change your status to visitor.

Thank you for your reply. I applied for a closed work permit and I am still working for the same employer. Does it mean that can wait till I get the decision from the cic and if negativ I can restore my status AND change my status to visitor without leaving the country?

I just want to make sure that I don't do something illegal.

Then you are not eligible to apply for a Tourist Visa (TRV). Scylla has already explained what you should do.

One piece of advice, use the correct terminology. Sometimes you can confuse us if you don't use it (there is no such thing as work visa, it is work permit) thus we can make mistakes while trying to help you.

I assume your employer obtain an approved LMIA? You need an approved LMIA to get the closed work permit approved. If your employer obtained an approved LMIA - then I don't see any reason why the work permit will be refused. And again, since you were on an IEC, there is no implied status and you would have had to stop working at the end of September. If you are still working you need to stop immediately and wait for the work permit to be approved before you start again.

I did not put an approved LMIA to my application because my employer did not have the LMIA at that point. I waited until last minute to send my application because I hoped the LMIA would still arrive. It did not so I send my application without the LMIA. I dont want to do anything in conflict with Canadian law. So I told my employer today that I will stop working until I have a decision on my application. Now I am not even sure anymore he applied for a LMIA at all!

Since I am starting to panic a bit and really dont want to be here illegally: Can I withdraw my application and change my status to visitor from within Canada? Sorry for goig back and forth. I am really worried right now.

If there was no LMIA then the work permit is going to be refused.

I would do the following:

1) Withdraw your work permit application (it has no chance of being approved).
2) Apply to restore your status and change your status to visitor.

Thank you so much scylla for your advice. I am going to withdraw my application by mail where I have sent it. And also I am going to change/restore my status to visitor online. I think so I will be on the safe side and will not get in trouble.
