they want to know if you are legally staying in USA when they interview you

they don't want to be embarrassed by later finding out you could be subject to deportation

if you want to emigrate to Canada you cannot afford to breach ANY country's immigration rules, it shows bad faith

my opinion only, take it for what it's worth

Am I understanding you correctly: you're currently staying in a foreign country for which you don't have a valid visa? Best of luck to you!

In answer to your query you MUST answer NO to the second question. As you've already said you don't have a valid visa.

case the answer is straightforward.

my advice

be honest, write and explain, you can't take the risk of lying and for CIC to find out later on during their background checks

i'm sorry you didn't like my earlier reply, and I thought about not bothering to reply to you again, but if you have broken immigration laws in US I have no respect for you, period.

my opinion in this case is:
a. If you haven't proved (with documents) to them about your status previous and current, then their question probably about asking you to prove the 1 year legal staying requirement.
b. If you already sent them ALL your proved about your status, ask they still asked that question then you may be in trouble.

If you are in situation a. I hope you'll be fine, since there are so many previous applicants with "immigration problems" in the U.S. are successfull in their PR Canada process.

If your are situation b, probably you sould consult to professional advisor (lawyer).
