Thx Lubob ,,,

Actually the other programs are difficult to have ... finding employer .. bla bla ... it was totally a silly thing of 500 apps. policy ... within 7 days CAP is reached !!!!
This is all very strange, people get their files back due to cap. reached but other people in the same NOC in later dates, have their fees encashed.
So it seems they just don't write the real reason for returning the file, just write cap full.
It seems as they stopped using NER (only one got a NER) and they are using this cap. reached excuse.

Thanks ScottishK. My ccard was charged on the 15th of August. I am thinking I should count 2 weeks from receipt of your PER for my own PER to come through. If and when we get our respective visas, we should move this forum to Facebook so we can begin to share settlement experiences. Bbq and beers will be in Calgary c/o Phil Chen. hahaha.

I am speaking like I have my PER in the bag. hehe. Scary.
Ha..ha~~absolutely no problem...I will prepare everything for BBQ plus beers for you two families coming next year..well.. if everything is going smoothly.... :)

i have experience of 240 weeks (4 and a half year) of continous full time working in my related field of dentistry. during this time i worked for two different hospitals. 8 months in one place and 3 year and 11 months in the other. in both the places i worked for 36 hours per week which was mentioned in my experience letter.
now my question is whether i will be able to claim maximum points for work experience as total hours needed for full time work for four years (which is required for maximum points) is more than what is required. but as per week statistic i was working 1.5 hour less every week. please let me know whoever has the answer to my query. i am very much concerned bout this. regards

Hi ALL

Just right now I have recieved an answer for my query about my application status :
Good Morning
Your file is still in the assessment stage, you will be contacted upon completion of the assessment of your file.
Thank you
D.A.

Well , very short reply for an email sent to them 13th Spetembre ( 14 days reply time ), my concern which I would like to share with you as follow:
1- my subject on mail was not as they asked to be firm query application status , in the opposite I put a long subject , apllication status with my name and date of recieved application , and date of cc encashed , and I recieved a reply now , so this is mean that all people who advises previously to follow strictly their instruction in sending mails is not good advise , CIO reply to any mail with any subject .

2- This short reply from CIO does not give any positive or negative action , so I think its almost like an automated reply , but with a human interfer . I think there is a specific system which the officer just enter the name or the passport number and automatically he can see on screen if there is an status or not , so if there is no comments , the officer just reply with this short sentence.

3- finally I will consider this email as nothing for me for the current time , and will just consider that no news still a good news .

Dear xxxxx xxxxx:

This refers to your application for permanent residence in Canada as a Federal Skilled Worker. I have now completed the assessment of your application and have determined that you are not eligible for processing in this category for the following reason(s):

The Minister of Citizenship and Immigration issued Instructions which were published in the Canada Gazette on June 25, 2011. Only applicants who meet the criteria specified in these Ministerial Instructions are eligible to be processed in the Federal Skilled Worker class.

You have indicated that you have work experience in an occupation with the following NOC (National Occupational Classification) code: 1122. Although this NOC code corresponds to the occupations specified in the Instructions identified by the Minister, you have not provided sufficient evidence that you performed the actions described in the lead statement for the occupation or that you performed a substantial number of the main duties of the occupation as set out in the occupational description of the NOC, including all of the essential duties.

After taking into consideration the work experience supporting documentation on file, I am not satisfied that you have performed the actions described in the lead statement for the occupation or that you performed a substantial number of the main duties of the position as described in NOC. As such, I am not satisfied that you are a 1122 – PROFESSIONAL OCCUPATIONS IN BUSINESS SERVICES TO MANAGEMENT.

Since you did not provide evidence that you have an Arranged Employment Offer, you do not meet the requirements of the Ministerial Instructions and your application is not eligible for processing

Note: Any reference to work experience in a NOC code other than those identified by the Minister of Citizenship and Immigration and published in the Canada Gazette on June 25, 2011 is not assessed for eligibility under Ministerial Instructions.

Your application, therefore, does not meet the requirements of the Ministerial Instructions.

Subsections 87.3(2)-(3) are the pertinent sections of the Immigration and Refugee Protection Act:

The processing of applications and requests is to be conducted in a manner that, in the opinion of the Minister, will best support the attainment of the immigration goals established by the Government of Canada.

...the Minister may give instructions with respect to the processing of applications and requests, including instructions

(a) establishing categories of applications or requests to which the instructions apply;

(b) establishing an order, by category or otherwise, for the processing of applications or requests;

(c) setting the number of applications or requests, by category or otherwise, to be processed in any year; and

(d) providing for the disposition of applications and requests, including those made subsequent to the first application or request.

The processing fee and, if applicable, the Right of Permanent Residence Fee that you paid are refundable. You will receive a cheque within eight to twelve weeks OR if you paid by credit card you will receive a credit on the credit card provided within eight to twelve weeks.

The refund cheque will be sent to the address provided in your application. If you have changed your address please advise us immediately of the new address. Address changes should be faxed to (902) 270-3561. PLEASE NOTE THIS FAX IS ONLY FOR ADDRESS CHANGES.

Note:

Any requests made on the basis of humanitarian and compassionate grounds accompanying a Federal Skilled Worker application cannot be processed unless the application is otherwise eligible for processing under the Ministerial Instructions.

Any requests for positive substituted evaluation accompanying a Federal Skilled Worker application cannot be processed unless the application has met the minimum requirements outlined under Regulation 75(2).

There are many ways to immigrate to Canada. Although you have not satisfied the requirements to apply under the Federal Skilled Worker class, you may qualify under another category. To learn more about your options, visit http://www.cic.gc.ca/english/immigrate/index.asp.

Thank you for your interest in Canada.

It's a positive sign I feel. B'coz your application is reached on 2nd Aug 2011 that means only 1 and half month is complete of your application. Secondly the timeline for CIO of giving AOR/PER is 90 days. I think you should wait for 4 weeks. They are right buddy
