    Things happen - does it really matter WHY it happened? The point here is right now he is out of status and they are trying to correct it. If he is eligible for the restoration of status do it ASAP so he can be in maintained status (previously called implied status).

    We used this form for so many things - it is worth having and I would definitely include it this round. We even included it in our married packet since it shows the history ( we started the process when we were common law but didn't submit it until we were married.)

    Did you submit a IMM 5409 - Statutory Declaration of Common-Law Union? If not, I'd recommend putting that in there too.

    I believe you can study online at Canadian schools without a study permit. You may also be able to take courses that are less than 24 weeks long without a study permit.

    You can apply for restoration of status with your application. Are you doing a work permit? If you do that then you'll be in implied status once you submit your application. Our lawyer said it can take longer if you aren't in status at the time of application ( it doesn't always- but it can)...

    You need to get legal counsel on two issues here. Your immigration and your custody/divorce issues. There are protections for sponsorship breakdown situations - Since you have a child - You may be able to apply to stay in Canada on humanitarian or compassionate grounds. Get legal counsel ASAP!
