How do I calculate the cap for LMIA Application

If the company haven't ever hired a TFW before, then they don't need to complete Schedule E, the cap is automatically 10%. If they do, then they'll have to complete it in order to find their current cap. The calculation is basically the total hours worked by all TFWs weekly divided by the...

How do I calculate the cap for LMIA Application

If there are currently no other TFWs in the workplace, the cap is 10%. If they have TFWs and they currently cover more than 10% of the total weekly hours in the workplace, then no more can be hired, apart from replacements for current expiring TFWs and provided they're no more than 30% already

one-year pilot OWP for spouses and common-law partners

Reasonable? No. As I said above though, have personally met a lot of people who have received very, very bad advice and service from lawyers. Last one was from a couple who are friends of mine, right where I live. First of all they advised an Inland application this September, which itself is...

one-year pilot OWP for spouses and common-law partners

The thing is: you might be fine but their mistake of not sending an OWP application with your PR one keeps you from receiving the OWP under the pilot program, which you might even have had already received by now

    LMIA application processing time?

Thanks Jay! It's not exactly the same as you were working before, but it's still interesting that they accepted your change to visitor until your LMIA came through. In our case, the family member that's waiting for the LMIA has a visitor status already and I have a dilemma. First choice would...

    LMIA application processing time?

Hey guys, the employer just received a phone call (13th week from file number creation) and was asked to submit additional info before the current LMIA app is processed. ::) Important question: has any of you applied for visitor extension while in Canada (again talking about visitors, *not*...

Ponga, you're either typing and posting too quickly or I'm too slow ;D

one-year pilot OWP for spouses and common-law partners

In any case, back when you applied, there was a "not" in that same page you found. It used to say "not required to have legal status", so even if it changed afterwards, your application is valid and will be processed. You'll more than likely be fine, as others said though, do not tell anyone...

Yep, that's the most likely scenario TBH

one-year pilot OWP for spouses and common-law partners

You could ask them and let's hope they did. If they did, then you'll also be eligible for the pilot program and will get your OWP. From what they've told you up to now though, I wouldn't get my hopes up

one-year pilot OWP for spouses and common-law partners

That's good advice to follow if you're within the 90 days timeframe, you'd have a good shot at getting back your legal status in Canada

one-year pilot OWP for spouses and common-law partners

Exactly. That's the definition of implied status. Notice that it talks about an extension of temporary residency (work, study, visit) and not filing a PR application. A request to become a PR does not grant you temporary residency status, hence not providing implied status.

    INLAND APPLICATIONS 2013

Coincidentally enough, we've got the same dates, apart from the started processing one, which for me was Jan 09 2014. Yes, I received my OWP on Friday, yours should be coming soon. 8)

one-year pilot OWP for spouses and common-law partners

I've heard much worse from lawyers and not talking just in the forum but in person as well, since my line of work involves handling immigration documents, so have talked with many people in similar situations, trust me on that. You get implied status by sending the application to change your...

Unfortunately she's wrong on both. Email conversations with a lawyer don't mean anything to CIC I'm afraid

one-year pilot OWP for spouses and common-law partners

Your experienced lawyer is wrong, which doesn't really surprise me considering all the wrong advice that has been given to lots of people by immigration lawyers. First of all it's a fully legal status, they should know that without any shadow of a doubt. Apart from that, many people with implied...

    LMIA application processing time?

Unfortunately there is no 100% chance, as they'll also check if the requirements on the LMIA match the applicant's skills, employment history etc. In any case, hope you get a positive one!
