U are absouletely correct, CIC will issue a statement that there is backlog to refund the processing fees. This time they might refund it (If ever) in the LIFO method. I think we may have to take them to court once again to get our fees returned.

It not about the law of the land. The million dollar question is why would an applicant who applied 8 years ago come under this particular law ? What was CIC doing all these years ? Hacthing eggs ? There is no backlog, but actually all are Wharehoused files. Theres a huge difference.
