Moving to Canada from USA with Approved I140

Completely agree with the above reply. When I was interviewing for Canadian companies from the US, even though I had a Canadian tourist visa (before I was officially a PR), most companies were willing to do a Skype interview for the entire process. If you did move to Canada as a PR, why would...

Moving to Canada from USA with Approved I140

If you have a priority date after mid 2012, and if the existing laws do not change, you will not see a Green card in this lifetime. Just look at the pending applications inventory from USCIS and the number of visas issued to India each year. You can, however, go back on a TN visa, or try to file...

Moving to Canada from USA with Approved I140

That's right, unless HR1044/S386 becomes law, any priority date after 2012 is useless in this lifetime for most people born in India. For China, it's not as bad, I think they have 2015 going on right now, vs 2009 (EB2) and 2006 (EB3) for India.

Moving to Canada from USA with Approved I140

I think you just need the I140 scanned copy. No employer will provide the original I140 to the employee. You can also have the labor certification copy, but I don't think it's required. As a new employer will need to file the labor anyway to process your GC application in the future. They will...

Moving to Canada from USA with Approved I140

Yup, getting the Canadian citizenship is in hand. Getting the green card, even if the bill passes, is dependent on maintaining H1b status for at least 3 more years, and hoping the employer will be kind enough, and stay in business, to file the I485. I'm rather just tempted to file in the EB2...

Moving to Canada from USA with Approved I140

Yeah, I will when the time comes. I think the restriction must be on a cap exempt H1b after the PD has been current for more than a year. So if one goes through the lottery and is willing to loose the PD, and gets picked up in the lottery, they can theoretically apply for the H1b.

Thanks for that input. I was not aware of the H1b rule, if PD is current. That is tricky. Does that come into the picture only for the employer that filed the I140 or for any employer? It does not make sense if it's a different employer, as by that logic someone from say Pakistan, for whom the...

Moving to Canada from USA with Approved I140

I moved to Canada as a PR early this year. I have an approved I140 from my previous employer, with a PD of April 2014, and I've been on H1-B status from Sep 2012 and my current stamp is valid till Sep 2021. I saw that HR1044 a bill to remove the country caps passed house. Hypothetically, if this...

Moving to Canada from USA with Approved I140

Yeah, TN visa sounds like the headache I was escaping from with H1b. I joined my Canadian company as an engineering manager, and they have a US presnce as well, which they are expanding. So my hope is I might be able to file in Eb1c with this company after Canadian citizenship in the future and...

Moving to Canada from USA with Approved I140

You are technically right about TN visa not being dual intent, but the only real catch is you won't be able to renew it after 3 years. *However*, if you time it just right, and your PD is current, you can file PERM, I140 and I1485 in under 3 years and get the green card, hence, not needing to...

Working from Home in US and living in Canada

If your home office address is on the labor certification as the official work location, it should not be an issue.

Moving to Canada from USA with Approved I140

Hi everyone, I recently moved to Canada as a PR last month. My I140 is approved with priority date of April 24, 2014. However, I'm no longer with the employer, though I left on very good terms, and I would be welcome back in the future (I was told by multiple people including my manager, the VP...

Is there any official documentation on exchanging an expired (<1 year) US driver's license in Ontario? Also, if I've driving history of 6 years from one state, currently, do I still need to get records from previous US states I've had a license from...

Landing after CoPR is issued ca I land on my tourist visa?

I'm curious, as I'm in the same situation as you. I'm from a non visa-exempt country, and I've a tourist visa valid till 2025. Were you able to do the landing in Canada on your tourist visa, or did you have to send your passport to get the PR visa stamp?

Passport request for COPR if already have a Canada tourist visa?

I don't have any issue, I was just curious; so that I can plan my travel to Canada based on whether I need to send my passport or not. Thank you for your input.

Passport request for COPR if already have a Canada tourist visa?

Case in point. So if I have a valid tourist visa to enter Canada, wouldn't getting another visa to enter Canada be redundant?

Passport request for COPR if already have a Canada tourist visa?

So I don't understand how someone who does not ordinarily need a visa, like a Belgian national, need not get this visa stamped? I thought the whole purpose of the PR visa is so that you are able to fly into Canada, the very first time, without any immigration issues from the airline.

Passport request for COPR if already have a Canada tourist visa?

I'm a citizen of India, currently living in the US and I hold a Canadian tourist visa valid till July, 2025. I have submitted my express entry application, and am awaiting a decision. I wanted to know if I'm approved for the COPR, will I have to send my passport to Canada to get the PR visa...
