have you mentioned that in your SOP ? If you have mentioned it and explained it clearly that you can't send your passport right away because of xyz reason then there should not be any issue with that. They need it on the next stage after medical. You have to submit your passport at that time...

I am not saying to go for Jan right away but send them a courier with all the evidences. my friends HSMP rejected, appeal rejected and then he send email saying that its unfair etc etc and in 15 days he got email of mistake and he got it. So give it a try, nothing to loose in it ?

I would suggest you to take a chance and send them print of emails sent (print should have the data time and email) and send the documents too THROUGH Courier. I am definitely sure you will get a positive response. There is a quite possible reason that you missed some information in your emails...
