    Yes, but I’m guessing that is because they did not begin their application? I should have been more specific sorry... Once you have begun your application you should be fine. For the time being, if there is no documentation that you are trying to resolve status (become a permanent resident)...

    My boyfriend is the same situation. DO NOT SAY HE IS WORKING! But, make him stop now cause if he gets caught you are screwed. I have talked to 2 laywers about my boyfriend being out of status. It is NOT illegal for your boyfriend to be out of status if you are in a common law or married...
