Have you thought about trying to achieve CLB 9 First language principal applicant? That could add 50 extra points beyond the language points.

If your NOC / function / employer does not fall under the LMIA exemption - answer No. On the other hand, after 1year full time permanent job in Canada you are gonna be able to claim points and fall under CEC.

To the majority of streams you do need IELTS. Concerning the second question, I believe that if you have time to read a lot about it and reliable documents to support your application you may go for it on your own. If you have second thoughts about the docs, I would have a lawyer to double check.
