Out of status, thinking about marriage... URGENT HELP !!

Hello,

I have been out of status because I made a mistake by applying for a work permit and got refused in August 2023 and spend the next 90 days by looking for lawyer and work with a specific requirements to reapply and reinstate ny status but no luck but after that I hired a lawyer from my family and applied for A trp and open work permit. The file took awhile to prepare and got sent on November 2024.
Today i left CBSA office and got officially removed from Canada but no departure date because I have to finish a courtdate.
Now my girlfriend and I been together for a year now and we want to get married to avoid this removal. I didn't want to get married until I got back my papers back but I have no choice.

My question is can a sponsorship for spouse be helpful for someone who is out of status ?

Second is how long do the cbsa give usually after issuing a departure date ?
I need 60 days to close everything and finalize some issues I don't want to leave with problems.

Third is if they didn't give me a departure date but still made it official of my removal because the courtdate, is there hope for immigration to give their answer before the departure? Or they work together ?

Im lost i need answers please. I'm panicking I don't know what to do

Had you not received the removal order, you could have gotten married and the submitted an Inland Spousal Sponsorship application, because those applicants do not need legal status in Canada to qualify for PR. Unfortunately the public policy that allows this, does not apply to a person that has been deemed to be `removal ready'.

Once married, your wife could apply to sponsor you via an Outland application, but if you end up being banned from returning to Canada because of your removal order (for a period of time), it will delay your returning to Canada.

The courtdate is about something else, about assault, pretty much for defending myself.

My removal is ready even without a departure date ? They can't interfere with my courtdate until it's resolved, according to the crown. But do you have an idea how long between the decision and departure ? Like They can't tell me leave me tomorrow, I should be given at least 30 days. Can I extend it through a federal judge to leave in peace ?

So a few things... Getting married and submitting the sponsorship application won't prevent removal if CBSA decides to remove you.

Frankly, right now, what is most important is to focus on the court date and do what you can to make sure the charges are dropped. If you end up being convicted, this could make you inadmissible to Canada. Please make sure you are working with a very good lawyer.

Just want to repeat the previous reply about your court case.
You may think it's "just defending" but if you are found guity for assault, you may be inadmissible to Canada. And that will not matter if you have spouse willing to sponsor you.
So get a good lawyer.
