PR Rejection Due to Alleged False Points for Foreign Work Experience

Hi everyone,

I’m feeling really stressed and disheartened after the recent outcome of my PR application. I’ve been in Canada for over 5 years, and this rejection has hit hard.

I applied for PR in April 2024, completed biometrics within three weeks, and had been patiently waiting for updates—only to receive a rejection yesterday. IRCC claimed I falsely declared 50 points for foreign work experience, which doesn’t make sense. I provided all the necessary proof such as:
  • Employment Letter
  • Bank Statements showing monthly salary deposits
  • Resignation letter from my previous job
  • IELTS score meeting the required standard (8 and above in all sections)

I worked in my previous role from November 2017 to October 2019 (almost two years). That’s what I reported in my application—I didn’t claim three years. I double-checked in the system, and even if I input just one year (to be conservative since it’s not a full two years), my IELTS score still gives me 50 points.

From my understanding, you can claim 50 points for foreign work experience either by having 3 years of work experience or by maxing out your IELTS score. I met the criteria for less than 3 years with my maximum IELTS score, and I verified this again in the system, which calculated the same result.

I’ve applied for reconsideration, but I’m honestly overwhelmed. If anyone has been through something similar or has advice, please share. Success stories would lift my spirits right now.

Also, if you want to claim the 50 points for Foreign work experience you must have at least 3 years of foreign work experience. If you only have 1 or 2 years, then you won't qualify for the 50 points.

I think you should only have been awarded 25 points. As I said before, post to the Express Entry section.

I almost have the same timeline , but I am stuck at security check ☹

If someone's PR application was rejected due to alleged false points claim, they wouldn't pass eligibility. In-fact, they would be rejected based on failing to match A11.2 criteria for their ITA.

Oh, I was just asking because I saw a case yesterday where someone received P1,P2 , and after that they revoked his final decision and his eligibility went back to in progress, after being passed from before , but it turned out that he applied for BOWP while his PR was based on LMIA.
btw, is it right that if you have LMIA, you can't apply for BOWP ?

Your application can be denied at any point. Sometimes concerns come up later in the process that may have been missed originally. Having LMIA and BOWP are not directly related.

This why I asked if he passed eligibility before or not, btw, I don't have LMIA and I Passed all of stages except security , still in comprehensive security check(fingers crossed)

Eligibility can miss things that are picked up later on in the process so until your passport is stamped there are always chances of refusal.

Hi guys, I need to know if anyone can help me with this please, my employer received the approval for my LMIA now I have to wait for my WP, what’s better wait here in Canada or in the country I reside. It takes more time if I wait inside Canada or in my home country? Thanks!

The application has to be an outside of Canada application assuming you are in Canada as a visitor. You can't apply inside of Canada due to the recent IRCC rule changes.
