Should I apply for a super visa for my parents after Visitor visa got refused twice?

Hello Members,

I am in a very sad state right now. My parents applied for a tourist visa twice and it got refused due to the following reasons:

• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your personal assets and financial status.
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your family ties in Canada and in your country of residence.
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on the purpose of your visit.

They have shown a liquid funds of around 30K CAD and with properties worth of 2 CR INR. My father is a standing counsel in the Delhi high court and he also showed that he draws salary from the Government of India. He also mentioned that he draws pension from one of his service. Here are the timelines:

1. Tourist visa applied for the first time on the Old portal : 14th May 2021(no response)
2. Tourist Visa Applied on the new portal: 16th January 2022(30th January refused and the old application was withdrawn automatically)
3. Tourist visa applied again on the new portal with better documentation and proof of funds.: (4th February 2022 - Refused 12th February 2022).

Now I don't know what to do. I was thinking of now applying for a Super visa but I am not really sure if there are chances for that to be approved? Could you please suggest?

Order GCMS notes before applying again to find out full reasons. If you are elgible for a super visa, your parents can apply but they still must address reasons for the refusal.

- How long of a visit did they state? If for a long period of time then $30k uses their savings.
- What family do they have in India?
- Did your father submit employment letter saying he had time off for a visit?
- Do they have travel history to visa countries like US, UK, NZ or AUS?
- You are a PR (how long) or citizen?
- Did you provide a letter of invitation? What were the reasons to visit?
- What did you change with each application?

Yes they are eligible for the supervisa. Please see my answers:

- How long of a visit did they state? If for a long period of time then $30k uses their savings.(Initially they applied for 5 months and then on the next application for 2 months)
- What family do they have in India? All their relatives including their parents are in India
- Did your father submit employment letter saying he had time off for a visit? No
- Do they have travel history to visa countries like US, UK, NZ or AUS? No
- You are a PR (how long) or citizen? 3.5 years total and 2 years on a PR
- Did you provide a letter of invitation? What were the reasons to visit? Yes, the reason for visit was to meet and stay with us as we have not met since 3.5 years. We have many events in these 2 months time frame like my birthday, my moms birthday, my anniversary, my parents anniversary which we wanted to spend together.
- What did you change with each application? I added property documents as well to show their financial status along with proper details about their ties with us.

  • They applied for too long of visits. 5 months - $30k (using all their savings for a visit). Keep visit to a few weeks. If you meet LICO for the number of family members then you use your statements.
  • If your father has a job then there is no way he could have taken 5 months (or even 2 months) off. Include employment letter with authorized time off and a return date.
  • Family - are they caregivers for their parents? If so include information. Other relatives other than children are not important. If you have siblings with kids in the country, that is a tie. If you are an only child or siblings don’t live in India, there family, home ties are weak.
  • Lack of travel history is an issue because they can’t show they will return home.
  • Reasons: During Covid/pandemic/lock down showing all these family events probably wasn’t the best idea. If apply again and restrictions are lifted, keep it simple.

Thanks, This is really helpful. However I am a bit confused about this statement "Keep visit to a few weeks". As super visa is for people who wants to stay longer than 6 months, how would I justify the application for their stay of few weeks?

Do they want to stay longer than six months now? Was the intent always to stay longer?

A super visa is for longer visits but you then need to show that your parents can stay long term. They are coming off two refusals back to back. Their refused applications have been for less than 6 months so now you want to show that they can come long term. They couldn’t prove they would stay or afford short term in the first two applications. Reasons for refusals will still be considered. Again I would wait a few months before applying for a super visa but it is their choice. Get their insurance and medicals completed.

Super Visa is not the solution - Try to more clarify on documentation from India and Ties, as mentioned reason of deny.

If the funds are in stocks they aren’t really liquid. IRCC likes seeing accessible cash. How much was cash?
