I have posted in the refugee asylum thread that I want to pursue H&C case for my mother as all her children are here and she is a widow and nowhere left to go. She lived in the Middle East and lost her job there and she has not lived in Pakistan which is her citizenship for over 40 years, so nothing to go back to. We have done 3 extensions of 6 months each already.
Before applying for H&C, my lawyer has told me to apply for her extension for her visit visa, under the "cover" of a super visa. We would need to show medical insurance and income requirements the same as the supervisa, but this is an extension that can be done within Canada.
I have been unable to find this category anywhere and am not sure of what he is referring to. He is charging over $1000 to do this for me (just the extension), and I'm not sure if it is legit or a workaround of some kind? I have spoken to another lawyer and he has said that this option does not exist - you should only extend for another 6 months.
I have not used lawyers in any of the immigration processes in the past and relied on this forum to do it for the whole family over many years, but I think H&C is more complicated so am trying to get a few consultations and make a decision... but in the meantime, this has left me confused as well... can anyone help with what this lawyer may be referring to?
