Hey @Ayanna how r u doing i see you help a alot of people here in forum and you know alot of things regarding h&c. I have an criminal inadmissibility for a hybrid offence prosecuted summarily and i am seeking inadmissible exemption under h&c as my spouse is permanent resident here is it a good chances of getting h&c approval or not or i should go for trp until i get my pardon please help me out

It’s hard to say if h&c gonna give you exemption especially with the fence you have it’s all depends how long the crime happened what was the mode of the crime describing is he/she eligible for rehabilitation/pardon
Is the crime happened in Canada or other country

Can you break down a little bit so I can show you the way

Hi guys , I called IRCC, the auto msg started we are reviewing your eligibility and at the end it says we are processing your background check . . Do they review eligibility and background check at the same time?

It’s automatic machine voice the same for everyone even to work permit study permit for PR or citizenship

Yes it was happened in canada in 2021 july i was convicted of refusing to provide breath sample

to be honest idk how they see it
Because you be convict the six months ago
It’s very fresh but we don’t know how they’re gonna seen it they have to send you a case to case management and those people are going to make decisions It will take more then year for them make decision

True and also your lawyers heard some sad news last year that someone that got pathway for Health care went home and was denied entry that on record there is a record that refugee was filed and is there no more danger. Ask your lawyer or call IRCC

Until you have been granted status nobody should leave Canada. There is no guarantee of reentry.

No guarantee if a TRP. How do you know you’ll be able to receive a pardon?
