That is not a refugee claim. Thats a Best interest of child claim... She should have shown sufficient evidence that her child is specifically at heightened risk in India. Again a more competent lawyer would have substantiated this better.
For instance, she should have shown that her child had very limited understanding of Punjabi or Hindi and cannot read and write and barely speak it that there by putting her at a major risk of academic performance in Punjab since she is already 8 and expected to possess those skill to function well in Indian schools. Should have included letters from Canadian social workers having specialisation in this field. Again, a competent lawyer would have prepared this argument way better. Better yet, should have produced samples of course work and books from Punjab board and level of Punjabi needed in typical government schools in Punjab (not private). Best interest of child specifically calls that Immigration cannot use the excuse of wealth to counter the risk argument.
