How would I get my daughter to Canada

Hi All,

Myself & my wife have been living in Canada and we got citizenship in 2014. My daughter was born in 2006. But we have not declared her name in PR application and Citizenship application. Is there any way to get her to Canada. Please suggest. Thank you very much for your suggestion.

As you have been previously told, your Adoption of Convenience will not be revognized. The only way to bring your niece to Canada would be as an intentional student.

Even if you legally adopted her in India in 2009, because you failed to declare her in your PR application as a dependent child at any time before you landed as a Permanent Resident, she is excluded for ever from Family Class sponsorship. See IRPR 117(9)(d). This is over and above the "adoption of convenience" issues.

Deal with it and move on with your lives.

You can try but it is not guaranteed. You will need to show that you have the funds to pay for her tuition and 10k of living expenses.

Will arrange the required funds. Here our names as parents in her passport. Is it not an issue while applying?

Yes that will be an issue. There will be concerns that she won’t return home if her parents are in Canada. Her only good option is to qualify for PR on her own.

She is unlikely to get approved for a study permit because she will have difficulty proving she will return to her home country. You can always try but her best option is to work towards qualify for PR from her home country

One last question. Still the same issue if she applies study permit after 18 years old.
