Hello All,

Seeking you advice to bring my children to Canada . Me and my wife hold PR which we have applied through FSW program.
My wife is the primary applicant and I am dependent. I am in Canada and my wife is in India with two kids .
When I referred https://www.canada.ca/en/immigratio...ship/spouse-partner-children/eligibility.html , under the below section " Who can’t sponsor their spouse, partner or child" ,there is is subsection "You may not be eligible to sponsor your spouse, partner if you:" which states "If you were sponsored by a spouse or partner and you became a permanent resident less than 5 years ago , then I am not eligible to sponsor"

Question
: Does the statement "sponsored by a spouse " mean "Dependent PR holder" ? Is it applicable for sponsoring children ?

No, you should be able to sponsor them, or at least that wouldn't be the issue .

Were the children declared when you became PRs?

No we got the PR in Jan 2020 and we did a soft-landing in the month of March 2020 and managed to comeback just before the lockdown.
And babies were born July 2021 and I traveled to Toronto recently and now I wanted to sponsor them .

Sounds pretty straightforward, my next question was going to be are you both compliant with residency obligation, and as recent PRs, you are.

So yes, go ahead and sponsor.

I have another question for my friend who has PR from May2019 where he is the(primary) and his wife .both are in India currently. Did a softlanding aug2019..blessed with a boy beginning of 2020 year.
He wants to move to Canada with his wife and son. Son doesn't PR..He wants to apply for temporary residence visa from India.. can he do it as he is still in india and has no job offer

They can apply for the son. No guarantee it will be granted.

One parent has to apply to sponsor from Canada and must remain i Canada during the sponsorship process. The parent must be compliant with their RO. You don’t need a job when applying but her should update his file once he has secured a job during the sponsorship process. He will need to show that he can support his family without government help RO sponsor his child.
 
Hi.. if i understand correctly ..my friend can still apply for tourists / TRV for his son and can plan to take his son along with him and his wife(possess PR) if it's approved

For PR sponsor i understand that one parent should be there is Canada while applying and during the process.
