Canadian Citizenship application for Indian citizen born in Nepal

Hello Everyone,

I have a urgent query regarding online citizenship application for Canada.

I was born in Nepal and hold Indian Citizen and came as PR to Canada in August 2018. I am now eligible for applying for citizenship. I have one question which I am unsure of the answer to. There is a question in citizenship application that, what is your immigration status in countries other than Canada (including your Country of Birth)?

The options provided are as follows: Citizen, Permanent Resident, Visitor, Refugee, Student, Other.

I am not sure on what would be my status I had registered as an Indian citizen in embassy of India. So basically i have no status in Nepal as such. Please help if somebody has been in similar situation

If the question is what status you had at birth in Nepal, I would put whatever status your parents had with respect to Nepal. The main thrust of the question is whether you have some status now, particularly citizenship, in Nepal,which may require some explanation.

If so, just include a short letter of explanation - brief and to the point. "Born in Nepal where my parents (citizens of India) were [working / visiting / whatever.] Currently I have no status of any kind in Nepal [because ... {if necessary}]."

I wrote 'if necessary' because for some countries, all children born in that country would be citizens (with limited exceptions like children of accredited diplomats), i.e. assumption may be that you would receive that citizenship. I don't know whether it's necessary to explain with respect to India/Nepal.

Since you're an Indian citizen you cannot be a citizen of any other country. If you have any other type of official document issued by the Nepali government you should add the status according to that. Otherwise an explanation letter as the member above pointed out should be enough.

In Nepal, citizenship is not given at birth, it is based on the citizenship of parents.

@motocrosstar : There is no official document issued by the government as indian citizens can work and stay in nepal indefinitely

There is a 1950 treaty between india and nepal of article 7 which says:

The Governments of India and Nepal agree to grant, on reciprocal basis, to the nationals of one country in the territories o the other the same privileges in the matter of residence, ownership of property, participation in trade and commerce, movement and other privileges of a similar nature.

They care what immigration statuses you have held personally. I wouldn't mention Nepal at all.
I suggest this is a bad idea for the country you are born in, even if no status currently.

If you were born in a country, you must have had some kind of status. Leave it out and they're going to ask questions.

IMO, don't know for certain.

If you were born in a country, you must have had some kind of status. Leave it out and they're going to ask questions.

IMO, don't know for certain.

If you have to declare an immigration status for Nepal, under that treaty, you could be regarded as a legal resident of Nepal. I think you should put:
  • Citizen of India by descent at birth in Nepal to Indian parents.
  • Legal resident of Nepal at birth per Article 7 of the "Treaty of Peace and Friendship Between the Government of India and Government of Nepal".

Select other and mention no status.
