Visitor Visa Refused - Evaluation of GCMS notes - Seeking Advice

Hello everyone,

I'm a permanent resident of Canada and my mother was planning to visit me. However, her visitor visa was refused for the following reasons:

• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your family ties in Canada and your country of residence.
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on the purpose of your visit.
• I am not satisfied that you will leave Canada at the end of your stay as a temporary resident, as stipulated in paragraph 179(b) of the IRPR, based on your assets and financial status.


Officer remarks as per GCMS:

Taking the applicant's purpose of visit into account, the documentation provided in support of the applicant's financial situation does not demonstrate that the applicant is sufficiently established that the proposed visit would be a reasonable expense.

I'm not satisfied that the applicant would leave Canada at the end of their stay as a temporary resident. I note that:
- the client has strong family ties to Canada.

The purpose of the visit doesn't appear reasonable given the applicant's socio-economic situation and therefore I am not satisfied that the applicant would leave Canada at the end of the period of authorized stay.

Weighing the factors in this application. I'm not satisfied that the applicant will adhere to the terms and conditions imposed as a temporary resident.

For the reasons above, I've refused this application.


Applicant Profile:

Age
: 66 (Retired Government Teacher)
Marital Status: Widowed
Purpose of Visit: To reunite with a family member (myself).
Proof of funds: CAD 26500 ( Fixed deposits, Provident Fund P.P.F and Bank statements) All belong to my mother. Her bank balance was around CAD 3000 at the time of the application.
Ties to home country: Property ownership letter. She lives with my elder brother and my other siblings are also in India.
Duration of Visit: 4 weeks
Travel History: None

Possible solutions:

I'm thinking of liquidating her Fixed deposits into her savings account which will bring her Bank balance in the excess of CAD 10000.

Provide Property evaluation by a certified evaluator.

What else I can show to make my case stronger this time? I don't have a strong bank balance either but my income is close to 100k. Will attaching an employment letter make a difference?

When did you move to Canada? How long since you received PR? Would suggest you also increase your savings. Is there a specific reason for the visit? How long has she lived with your brother? Are there any other family members who live in Canada? Does she need to be in India for a certain amount of time to receive her pension?

I would suggest not to disrupt her finances. It is all dependent on the visa officer. Your mother's case is a typical case of middle class Indian mother. Please re-apply after a year with a nicely drafted letter rebutting the causes.

4 years, Will be a citizen by the end of this week.

Would suggest you also increase your savings.

Definitely, Working towards it. Initial years were challenging. :)

Is there a specific reason for the visit?

None. She never visited in the last 4 years so I thought this would be a good time for her to visit.

How long has she lived with your brother?

45 years. :)

Are there any other family members who live in Canada?
Just myself.

Does she need to be in India for a certain amount of time to receive her pension?

Not sure about it.

That’s her money only.

If she must in India to collect her pension that would be a good example of a tie. You can highlight the fact that the eldest son traditionally has his parents live with him and that is the case in your family if that is the actual reason your mom lives with your brother’s family. Does your mother help with childcare or does she take on a certain role in the household? Are her parents still alive? If so, does she provide assistance for them? Did you get PR through express entry? I fail to see what your mother’s strong family ties are in Canada with only you in Canada.

So, if I apply again with this new purpose of visiting and addressing all other concerns of the VO, do you think I have a good chance of success? @canuck78

On top of it, ask you local MP for a letter of recommendation etc. I know a guy who invited his parents for a wedding function and used this trick. Good luck!

Would suggest increasing your savings and highlighting your mother’s ties like living with your brother, providing informal childcare for grandchildren. Would not cash out any fixed deposits.

I reapplied my mother’s visa in December 2021. It’s been more than five months and only criminality verification has passed. Given that the previous refusal came in 10 days, Would it be safe to assume that this time the application is moving in the positive direction? Does rejection happens after this much delay?
