My MP replied me last week. It has been a month since HK office asked for additional documents and medical request on the end of Oct.
Not much surprisingly, the eligibility assessment not even started. What is the outstanding assessment for? So ridiculous.

Requested documents were received on November 2nd.
Medical also received.
Eligibility and Security – not started yet
Criminality- still in progress
Medical – passed
File is moving forward normally, you need to wait for the officer to finalize the file, as they are still outstanding assessment to be done.

I’m a Canadian citizen living in the U.K. and will be relocating back to Canada. I left canada many years ago but started the application with the hopes that when he receives his visa I will make the move back. I really need some advice. Should I appeal with a lawyer?

HI and I am sorry that you were denied. Welcome to the fight! This is the place you will get a lot of information and support. Yes, you should absolutely fight the decision. It is up to you whether you choose a lawyer or do it yourself. We went the route of lawyer for peace of mind, support and guidance. A lot of couples here have done the appeal themselves and handled it very successfully.

You have 30 days to file a notice that you will fight the decision. Do that right away. Then you can think on whether you want to do it yourselves or with a lawyer.

Accra uses the "relationship not genuine" umbrella all the time, so don't feel bad about that. If your relationship is real, and it means something to the both of you, then fight. Order your notes to see what the objection was and then prepare your evidence in support of addressing all of those concerns. Again, you will get help here on the forum (I suggest you read through this thread, it'll give you great insight) or you can get help through a lawyer.

It's a long battle and it will be hard. People have been on here for many years and are still going through the process. We applied in July 2019, denied Feb. 27/20, appealed and won Feb . 9/21 and we are still waiting. Don't be discouraged by this. If the marriage and relationship means something to the both of you, then it is worth the fight. Good things don't come easy.

I honestly think it was sent to Warsaw right after the digitization. At least this is what I want to believe haha. It was allowed on May 4th 2021, got the notice of decision on May 5th. Since then two appealed files from March and June 2021 were reopened by Warsaw and finalized long time ago. But mine is still somewhere in between. The last update from our MP is that it was sent for digitization on Oct 6th.
Yes they will send the application to VO after digitization but its still under the process of digitization so far. Our appeal allowed on May 26 so we are closer and file sent for digitization in same batch so will get the update soon. Hopefuly you MP will give some update soon and i wish they finish this digitization soon and send our applications to VO soon.

Called IRCC this morning and was told that NYVO acknowledged receiving our digitized file on November 3rd. File was sent on October 8th.
Don't know why the last agent said NY acknowledged it on October 12th. I'm going to stop calling these lazy people, as the information is never the same.

Sorry to hear but submit the appeal letter immediately, wait for the blue book which will have more information as to why they do you believe the marriage is genuine. You can then decide if hiring a lawyer would help you best.

They are good for nothing. Some are so rude and heartless they simply say sorry we can’t even give you any info since we are working on prioritize applications. I don’t know these applications gonna finalise. This is more than enough now.. i want someone to hear our noises. Nothing but wait we can do!

You are hearing the answer 'appeal' but appeals can take a long time. In some cases it may make more sense to apply anew - IF the issue can be fixed. This is where it is useful to look at what/why they believed the relationship was not genuine - order you gcms notes, for one (right away).

"Relationship not genuine" is not straightforward. You should speak to a lawyer (in my opinion). But you don't have to choose a lawyer to notify you wish to appeal, and you can withdraw that appeal later if you choose to (i.e. do not miss that 30-day deadline).

Thank you so much. This gives me hope and strength to know I’m not alone and to just keep fighting.

No we don’t. He lives in Nigeria and I’m currently in the UK but relocating back to canada soon
There are honestly not many files (that I've seen anyway) where Canadian citizen abroad is sponsoring spouse living in a different country than the sponsor. And caveat that I don't know anything else about your file (time together, how much you've lived together, when married, etc.

So this is a bit of a guess but I suspect not living together is part of the issue. I suspect that IRCC's 'mental image' is that the point of sponsoring-from-abroad is that it is a mechanism meant for couples living together outside of Canada. (Note, i'm not arguing that it should be that way or is required, but that the mental image or model may nonetheless dominate)

An alternative to appealing would be to 'correct' the perceived issue, if indeed the doubt comes from not having resided together much. As well as a frank assessment of the other weaknesses of your file. You'd also need the gcms notes.

In other words, if you could both live together for some period before re-applying, perhaps that would address the issue. (Would likely help quite a lot in context of an appeal as well)

Note, I'm not at all trying to recommend one route over the other - no way to know which might be better. Just that it is an option. (Living together to have better documentation and support for genuine relationship is pretty simple to recommend though)

I was also told by the agent that file digitalized and transferred to VO on Oct. 08 but then I ordered GCMS notes which showed file actually transferred on Nov. 09 and on Oct 08 was only digitalization was done not transferred. Appeal was allowed Aug. 07, 2020 and still waiting for file to be reopen.

let me know when your file is done being digitized. I’m honestly soooooo pissed.

August 2020...wow. Yes, it looks like from the time of digitization and transfer takes about a month.
