So long story short, i have overstayed for over 4 years now, but at the same ive been living with my common law continuously for past 4 years and we have all the joint accounts like bank,credit card, utility bills , CRA , insurance. We have even have common law civil status , so the only thing missin is me not having valid status. With that being said, do i have better chance of apply with help of lawyer or do it myself?
Lawyer is askin for 5k
Also what are my chances here

Sorry not a boy, but in my option you might have a high chance considering you both have a lot of shared accounts and probably a ton of photos and evidence of your relationship saved up.

My partner and I did our application without a lawyer and it was a headache and a half...but we done did it. However we had it recently returned to us after6 months due to one small missing thing..so we have to correct that and wait another 6 months now. So if you have 5k to spare in order to perfect it do it. Otherwise you can do without but id advise you just to check out the forms you need to gather to see if you want to go down that path.

Alternatively you can do it all on your own and go to a lawyer to check it all, I'm sure there are some out there. In which case it will probably be a lower cost that way.

Thank you so much for your info.

Well i dont have 5k spare, im borrowing it from my dad. I was little hesitant just because you can submit everything electronically now instead of paper but like you said i dont wanna make any mistakes or miss something.

Also not a boy LOL. But it's definitely doable to apply without a lawyer. Read all checklists carefully. Reread them. Double and triple check that everything is there and in the format they require. Have your spouse/partner/a trusted friend also go through and double check too. It's quite doable to get it done without a lawyer

Well i honestly rather do it myself as i always did myself before but since this time i dont have valid status for almost 4years i dont think it will be that straight forward so i dont wanna like get rejected because i didnt something right. I dont know im so confused i have untill tomorrow to let my lawyer know

in that case your situation is not as straight forward.. Most likely the lawyer will be a better decision since they know fancy words and are..lawyers. Hopefully he can help with a work around on that. There will be questions of where what youve been doing for the past 5 years as well as work related questions. But they also accept letters of explanations which your lawyer could help with..perhaps there are loopholes he hopefully knows of. Good luck, hope everything works out.

I'm not familiar with cases like yours, but here's my general advice:

Don't let the lawyer pressure you to make a quick decision. They're the one that need your business, and there are thousands of other lawyers. If there's no good reason why they want an answer from you tomorrow then I would suggest you find another lawyer that deals with you properly. Take your time in investigating your options.

I think your question should be whether you need additional documents given that you've lived here without status for a long time. If yes, then what are they? Once you know what documents you need, then you can make a rational decision on whether you are capable of doing them yourself or if you need to hire someone.

You've waited for 4 years, what's an extra month going to change? At least you can continue with confidence in your decision.

You should also use the advanced search feature here and see if you can find similar cases on the forum. I'm pretty sure you're not the first one with that situation.

Well i did not work or study because i didnt wanna make my situation any worse than already is and i also know i shouldnt work with no status. And i just been living with my gf didnt go anywhere and out of fear obviously i kept postponding it. Well based on the guidline they just need explanation letter and this is why i wasnt sure and i wanted to seek a lawyers help. Just weighing my options

So on the laywer side, well they didnt pressure me , i kind of said i wanna start my application asap so they were like let us know tomorrow but i can take my time plus i used CBA website to find a well known one.

On the part for additional documents , i think i need an explanation letter for that but i have to check that with lawyer i guess

And yes trust me ive been serachin for past two months just investigating the shit out of google and the foams here and i did find at least 10 similar cases which seems they all got thier PR. One case that got my hopes up , there was a guy who lived overstayed well over 10 years and he even worked during those years but still managed to get his PR. So i was like i didnt even work or study illegally. So i dont know

As a first step to figure out how much you are ready to do this on your own, download the forms and fill them out and get ready.

That really will help you understand.

Plus there's a chance that if you come with a complete, ready, organized package, that a lawyer might give you a better price.
