Hello,

I married someone in Korea and came to Canada together on January 2015. We both had a working holiday visa at that time and as soon as the visa was expired, I applied for a student visa, and he gained an open work visa. Luckily, he was eligible to apply for PR, so we applied for it together in 2017. On August 2017, we both received PR. As things didn’t work out, we decided to live apart from each other and got divorced in 2020.

Here is my question:

Can I sponsor my boyfriend who is living in other country to get PR? Do I have to wait since I became a PR less than 5 years?

You can sponsor your boyfriend once you are either married or have lived together for a full year continuously to become common law.

If one and other did not have PR based on sponsorship program, No 5 years restrictions rule applied. This happen when one a PR sponsor the other one under the sponsorship program to become PR as well.

I don't think you used this program.

When you say you decided to live apart from each other when did you start living apart?
